Tier 2 General Migrant - Architect - SOC 2431 Minimum wage

Post by milly_moon » Mon Jul 27, 2015 4:00 am

i'm desperate to find out any information from other architects applying for tier 2 general migrant using SOC 2431

i earn 32k/yr/40hr week
so my wage broken down to hourly is 15.38/hr

the minimum wage for 'experienced worker' is 15.48/hr

the minimum wage for 'part 3 graduate/newly-registered architect' is 13.46/hr

the minimum wage for ''part 2 graduate' is 11.39/hr

technically I am a part 2 graduate as I am not registered (neither in Australia or the uk) however, i have 14 months work experience in uk and 4 years work experience in Australia. I previously held a tier 5 youth mobility visa.

on my rlmt, soc and visa application I have used the title 'project architect'

does anyone know which minimum wage they will use for me?

are wages counted per pence? or rounded to the dollar? if they are rounded to the dollar I may scrape through classed as 'experienced worker'

if I get refused, which I fear maybe likely, what are the chances of an admin review with the argument that my minimum wage should be against part 2 / part 3 not experienced worker?

my priority service visa arrives on Thursday, I would really appreciate any advice out there.

I have found this guidance on https://www.gov.uk/government/uploads/s ... ctural.pdf

Caseworkers should not reject an application for a graduate experienced
architect who is not ARB registered, on the basis that the job title or
advertisement includes the word ‘architect, if it meets the work permit criteria.

This document is obsolete, from the time when Tier 2 did not even exist. That is why it is marked "Archived".

That said, If your CoS mentions your rate of pay is equal to or greater than 31400pa then what is your concern here?

because the 31400 is calculated on a 37.5hr/week
but my cos is based on a 40hr week so I don't
meet the min wage/hr
