PBS T1(G) dependent to FLR(M)?

PBS T1(G) dependent to FLR(M)?

hi all,

My wife is currently on a PBS T1(G) and is eligible to apply for her ILR. I moved to UK as a PBS T1(G) dependent in June 2014. Now my wife and I are a bit confused regarding how we should proceed with my visa extension once she gets her ILR.

1) I extend my visa as PBS T1(G) dependent until I become eligible for ILR or
2) Switch to FLR (M) once she secures ILR

Note: My PBS T1(G) dependent visa expires Mar 2016.

the only issue is the exceptions stated in the eligibility criteria..
"Your partner originally had a temporary visa as a worker
If your partner was in the UK on a temporary visa before settling or becoming a British citizen, you may have to apply as a ‘dependant’ (partner) in their original visa category."

can some on clarify on whats the best way forward? Thank you!!!

1) I extend my visa as PBS T1(G) dependent until I become eligible for ILR or you can continue on this route until you qualify for ILR and will require 1 more extension on PBS Dep form.
2) Switch to FLR (M) once she secures ILR You can do this too, it is your choice, but your clock will reset to zero for ILR and you will have to wait a further 5 years on FLR(M) before you qualify for ILR.

From what I've looked up, I will have to apply twice to meet ILR eligibility.

Are there any specific advantages of switching to FLR(M) than staying on PBS? One foreseeable issue is what new rules UKIV would come up with to prevent extensions under PBS options in the future.

Well we wouldn't know what rules will change in the future.

The choice is yours, you can do either. FLR(M) is cheaper than PBS dep, especially given the cost of the NHS surcharge as well on top of the visa fees.

Thanks again. Certainly the FLR(M) is cheaper than the PBS dependent route.

However my main concern is with the exception stated in the eligibility page. Does that not affect my FLR application since I moved here as a PBS T1(G) dependent?

You have a choice, many PBS dep do switch due to uncertainty of future HO rules, costs or for personal reasons, especially if the PBS dep has only been in the UK for a short period of time then losing that time towards ILR is not a big issue.

hi all,

Just thought I'd update all forum members that my application for FLR(M) was successful. Thanks to several posts (by forum members) and replies to my earlier post (by Mods?) for clarifications (& confusions) that helped me.

Background:
Moved here in June 2014 as PBS T1(G) dependent. Partner got ILR May 2015.
Successful FLR(M) Premium service application @ Glasgow - July 2015!!

Main issue was switching from PBS dependent status to FLR(M) - but the mods have been great!

Hi,

The following is a bare minimum if you're applying FLR M for the first time.

- Bank statement, payslips to prove the required income.
- Employer letter with the expected details, Appendix FM specified evidence
- English language test in speaking and listening at level A1( need to confirm level )
- Marriage certificate
- "Official" correspondence letters addressed to you and your spouse. They require a minimum number of letters, you need to check how many.
- Anything else you can add to show your relationship is genuine/subsisting. ( photos etc )

Above only a guidance. Please run through the form and guidance notes.

Just one more clarification on below query.

If my wife apply to FLR(M) then do I need to pay for IHS? I'm try to get an appointment for my wife in online at PEO but it is asking to pay for IHS - £500. I'm bit confuse here, I thought for FLR(M) no need to pay.

Could you please clarify on this issue.
