Tier 2 ilr salary threshold

Hi,
I am earning currently just over 33k excluding bonus and eligible for ilr in May 2016. Assuming I can get additional duties and salary, I will be over 35k by that time.

My question is, is 35k requirement applied to at time of application or whole fifth year?

This question has been answered many times on fourm. Please do some research before posting question. Now answer of your question is that you need to meet the 35K salary requirement at the time of your ILR application and not for whole 5 years.

You will be required to earn at least £35,000 at the point of application. Also bear in mind that you will need to submit payslip(s).

Hi both, thanks for the reply. I just concern a bit too much. I have managed to get extra duties at work. But that will come as additions in my payslip, rather than under base salary and I am not sure that will be ok?

It is "minimum salary threshold as prescribed for the year in question" or "SOC rate of pay", whichever is higher!

Earning minimum salary doesn't help if the SOC rate of pay is higher.

Thanks for the reply :)
As additional support role, it is just over 2400 a year more I had secured for myself.
My base pay is 33200 per annum. So total is more than 35k. Soc code for my job is 2136, which is 29600 per annum.

I am not sure if I missed anything though. I will have about 8 payslips with over 35k rates and the other 4 months with 33k rate, when I apply for ilr in may.

I got another question, my rate is currently about 35690.00 per year for 40 hours per week. I just been doing some calculation regarding 35k for 39 hours per week.

39 hours = 35000
40 hours = (35000 / 39) * 40 = 35897.43.

Does that mean my pay is not eligible yet? :(
