Finally how did you managed?
my contract was extended and I got ILR.I presume there is no hard and fast rule that Tier 2 to ILR employee need to be on open ended Job contract. "Foreseeable Future" is not needed.

The law:
245H(d) wrote:(ii) certify in writing that:

(1) he still requires the applicant for the employment in question, and

(2) in the case of a Tier 2 (General) Migrant applying for settlement, the applicant is paid at or above the appropriate rate for the job as stated in the Codes of Practice in Appendix J, or where the applicant is not paid at that rate only due to maternity, paternity or adoption leave, the date that leave started and that the applicant was paid at the appropriate rate immediately before the leave.
Where is the mention of "foreseeable future" that this topic was created for?

If I see the below post from you, there is a Employer letter format specically mentioning about the "Forseeable future".

http://www.immigrationboards.com/indefi ... 76413.html

Here is my query

1. If my employer gives me the generic letter saying that the employee is working for us now and the employee SOC code is xxx and his salary is xxxx which is at above levels...is that fine?

2. Is there any other additional requirement for the same?

Thanks in Advance

1. Ok
2. Letter must also say "employee is still required for the position"
Nothing else is required

Unpaid Salary - ILR

Post by stanza123 » Sat Aug 01, 2015 11:31 am

Hi seniors,

I have query regarding my unpaid salary

I have some 8 days unpaid leave in July month and my employer mentioned the same in payslip as well.

For example say: Unpaid Leave 8 days * xxx amount

1. Will this be any problem for my ILR?
2. Do I need to submit any proof for this?

Does that payslip show a "gross salary" figure that is same as it is in other payslips? Or is it lower?
If lower, is it lower than than the SOC rate of salary?

<<Stanza123>>: Yes ..the payslip shows the gross salary (for June and July months salary together it is showing in July Payslip since I did not get my June salary due to some technical issue) as other payslips and the Unpaid leave amount got deducted and paid the NET amount. But all entries are showing in the payslip as follows.

July Salary: xxxx ( this is for July gross salary for ex: say 3000)
June salary: xxxx (this is for June gross salary for ex: say 3000)

Unpaid leave: 8 days * xxx amount ( For example say 1000)

Total gross salary it is showing : 3000+3000-1000=5000

Net Pay: After deducting the unpaid leave xxx amount.

If lower, is it lower than than the SOC rate of salary?
<<Stanza123>>: No...it is above the SOC rate of salary

Thanks for your response sushdmehta!!!

1. Do I need to show any evidence for my unpaid leave?

2. Do I need to show any evidence that my 2 months(June and July) salary is in one payslip?

3. These 8 days do I need to mention in SET(O) form?
