Born in UK in November 1983

Post by mhib » Mon Aug 03, 2015 9:44 pm

Hi,

I friend of mine is having an immigration dilemma. She was born in the UK while her parents were residents in there in November 1983 (few months after rule change). Since then her parents left to overseas and now she is a New Zealand citizen.

She moved to the UK a year ago on a YMS visa which is granted for under 30s Kiwis. Now her company is asking her whether she does need sponsorship or whether she being born in the UK will allow her different status to any (outside EU) foreigner.

She has checked the law and there seems to be an article on the fact that she does not need a Visa, but does need a permit to stay by the immigration. Can anyone please clarify?

Thanks for your help.

One thing to also note is that she is not looking for citizenship just a better understanding of the right to remain in the UK

Unfortunately, being born in the UK does not confer any additional benefits to adults.

Were any of your friend's grandparents born in the UK? If any one of the grand parents was, she would qualify for a five year Ancestry Visa, which gives her the right to work in the UK, followed in five years by ILR and one year later by citizenship.
