Am applying for my ILR in the next two weeks. Please advice on the following query below:
Section 6 - 6.1 -> When did you first enter the UK?
Am answering this as 20th August 2009, as that was the first time i came to the UK. Gurus, please confirm this is correct.
Yes, that's correct the date of your first
entry.
Left UK Came back No.of days out of the UK
20th Nov 2009 ---- 21st June 2010 ---> 213 Days
26th Aug 2011 ---- 21st September 2011 ----> 26 Days
13th October 2011 ---- 17th October 2011 ---> 4 Days
10th July 2012 ---- 25th July 2012 ----> 15 Days
26th Jan 2013 ---- 25th March 2013 ---> 58 Days
04th May 2013 ---- 18th May 2013 ----> 14 Days
20th Sept 2014 ----> 26th October 2014 ----> 36 Days
Please advise on the following queries based on my timelines above.
1. In Section 6 - Immigration history and question 6.2 - Give the dates you left and returned to the uk with reason.
Do I need to mention my out of the uk duration of 213 days, as am eligible to apply for ILR even if i do not count the period of absense from 20th Nov 2009 ---- 21st June 2010.
You have to declare your absences from the beginning of entry but it doesn't effect your ILR application as it is no more than 180 whole days absence are allowed in any of the five, four, three or two consecutive 12 month periods, depending on the category, preceding the date of the
application for indefinite leave to remain (ILR).
2. Section 7 - Question 7.11 - Please provide details of any period of absense of more than six months during that time?
Do i need to mention my absense from 20th Nov 2009 ---- 21st June 2010 of 213 days, as my continuous 5 years stay falls outside of the 213 days.
Your stay in UK would count from the day you have arrived in uk(from 20th aug 2009 in your case) And yes you do need to mention about your 213 days absence. This is to verify your personal history (crime convictions& war crimes), it wont effect your ILR applications as it falls outside the qualifying period
3. I left UK from 20th Nov 2009 ---- 21st June 2010 as was not getting a proper job and had some family issues as well. Now if they ask me what is the reason of such a long absense, am not sure what to say and what evidence to give to justify this long absense. Can you please advise if they can reject my visa for this long absense and how should i tackle this question.
You dont have to provide any evidence for this absence again for the same reason it falls outside the qualifying period. You can tell them that you had to take care of your family back home or something similar
Regards...
Home Office Says**details for continues period should be used in Section 6. So, can I ignore 20th Nov 2009 ---- 21st June 2010 ---> 213 Days, then the continuous period starts from 21st June 2010. Is my understanding correct!!!1. In Section 6 - Immigration history and question 6.2 - Give the dates you left and returned to the uk with reason.

Home Office says**I need to fill this section if I have more than 6 months absence after 21st June 2010.2. Section 7 - Question 7.11 - Please provide details of any period of absence of more than six months during that time?
