Dependent ILR Situation

Hello

Need some advise on my status

My wife got her entry on October 2012

My ILR application will be made by April 2016 , can my wife apply for ILR or she has wait for 5 years from 2012 OCT?

Its just the settlement page says

to be eligible for the partner to apply for settlement it should be

5 years if you applied for that visa on or after 9 July 2012

Its is just confusing on the changes done by UK government

The settlement pages say she has to wait 5 years to apply for ILR since she got her first visa after 2012 July

Is this the case ?

i am applying for ILR by 5 years Tier 1 general route

My son who was born here , can he register as British citizen with just my ILR ?

I can understand from the page that

1.my wife has to wait for 5 years probationary period since she got entry clearance after 9th July 2012 as PBS Tier 1 dependant , now she will apply for FLR[M]

2.My son can register as BC after i get my ILR

Please correct me if am wrong

Correct.

Wrong!
If she does that, she will have to wait 5 years from the day she is granted FLR(M) to be eligible to settle.
She should continue to extend leave as PBS dependant before her current leave expires ... this way she may be eligible for settlement in October 2017.
