ILR for myself wife and child - 10 Year route

ILR for myself wife and child - 10 Year route

Dear all,

hope you are well.

I have a question regaring ILR. I arrived in UK on the 22 of June 2005. I have completed 10 years and will be applying for ILR soon. below is the time line of my visa status

2005 -2009 Student Visa
2009 - 2011 PSW visa
2011 - 2014 T2 General Work Visa
2014 - 2017 T2 Genral Work Visa

My Wife joined me in UK as psw dependent in 2010 and then she is my dependent on T2 General up till now.

I will be applying for 10 year route and my questions are:

1. Can my wife can apply for ILR as well as she is with me on T2 General visa for more than 2 years? If not what are my options.
2. I have a daugher born in uk in Jan 2013 what categories can i apply her visa.

1. No. If she cannot apply for SET(LR), then after you are granted ILR, she may apply for FLR(M).

2. After you are granted ILR, your UK-born daughter will be entitled to register as a British citizen.

tier2 dependent status after partner ILR

Dear All,

I have Tier 2 general visa since september 2011 valid until sep 2017. My wife is Tier 2 general dependent also since sep 2011 visa valid unti sep 2017.

I have already completed 10 years and will be applying for ILR long residence this month.

As you know dependents cannot apply together with 10 year long residence application for settlement. My question is when I will get ILR will my wife visa be automatically canceled? And will I need to apply for family dependent visa?

If her visa remains valid she will complete 5 years on tier 2 general dependent in september 2016 so can I apply ILR for her in Sep 2016?

After you are granted ILR, she should switch to FLR(M) as soon as possible, unless she qualifies for SET(LR) before expiry of leave. Unfortunately, her qualifying period for SET(M) will be reset.

Thanks you for your reply.

She will complete 5 years as Tier 2 dependent in September 2016 and her visa T2 General Dependent is valid till September 2017.

"unless she qualifies for SET(LR) before expiry of leave" Does that mean i can wait and do not switch to FLR(M) and apply for for ILR in September 2016? (5 Years on Tier 2 Dependent) her current leave is valid till September 2017 as my T2 dependent.

SET(LR) requires at least 10 years legal residence in the UK.

If you are granted ILR under Long residence, then they won't be eligible for SET(O) as your (PBS) dependants. 319E fails.

Hello,

I decided to apply for ILR on 5 years route and waited for a year, Now I will be applying in 2-3 weeks for ILR 5 year route for myself and my wife. My Tier2 General visa is valid till September 2017 (around one more year) and my UK born daugher (4 years old) has pbs T2 dependent with valid until setptember 2017.

My question is can she travel on this Visa (PBS Tier 2 Dependent ending September 2017) from UK to Pakistan and back to UK after i get ILR. I know from UK to Pakistan there will be no problem as she got pakistani passwport, Comming back however will there be problems? want to make sure there are no surprises when coming back

Any reasons why you are not looking at registering your daughter as a British citizen after you have gotten your ILR so she gets a British passport as you have been advised previously?

As advised previously by another fellow you can register your daughter as a British citizen after you have gotten your ILR so she can get a British passport.

Yes I can apply for it and I will apply her application as British Citizen but after coming back from Pakistan in about 2 -3 months after i get ILR.

What will be the status of her visa after i get ILR?

Yes the child can travel on her current visa, even if you have ILR, her visa is still valid.
