CoS unused & lapsed, new CoS for the same job post is poss?

Hi All,

My employer had issued a CoS in April 2015, it was never used and now its lapsed after 90 days.
Can they use the same job post and get a issue a new CoS. Or they need to go thru the RLMT once again.
Kindly advice.

A new RLMT is probably needed in your case as it is only valid for 6 months.
May I ask why you didn't use the COS?

Hi Shannon5g,

Thx for your response. Due to a medical emergency with one of my parent, I had to stay back in India. And it took more than 90 days for things to settle down. My employer has kindly agreed to issue a new CoS.
Out of curiosity, I wanted to know if they will have to do a new RLMT as the previous CoS has just expired a month ago... Or they will be successful in getting a new CoS based on the same job post.

It doesn't matter what date the CoS lapsed I think. What matters is if the RLMT was done within 6 months of applying. Assuming the RLMT wasn't just finished before applying in April, and you'd be applying in September, I do think you'd need to do another RLMT. Even if it was finished in early April right before applying, I don't know whether they only care that the end date was within 6 months or the entire thing was, so I would say an RLMT should be done anyways to not risk rejection.

Thank you for the response.
29.2 from the document posted by Manci clearly states that if COS is not assigned by the employer within 6 months, it can be used and assigned.

In my case COS was not shared with me, I guess it was not assigned.

Where in 29.2 it says the CoS can be reused? It says that the sponsor must assign the CoS within 6 months of the start date of RLMT.

Hi Moonlight55,

Yes you are right. My Understanding was, if my employer has not shared the CoS with me last time, does it not mean they have not assigned it to me(correct me if I'm wrong). If it's correct then they still have time to assign the CoS as its within the 6 months limit.

What do you think, will I be assigned the existing CoS or employer will mandatorily have to go for another RLMT.
