Im new to this group. My sister in law applied for spouse visa on 26/05 biometrics in karachi. We got the passport back today and unfortunately it was refused

i need some advice on how to go forward with this.

The grounds of refusal were:

- english language test they have tried to verify the test with the certificate number, reference number etc and were unable to find any evidence that the test has been taken and refused on that basis. We have checked with the awarding body and it appears that many people have the same issue of not being able to see their results and they will confirm if its the case in writing with my sister in laws certificate.

- covering letter from employer with details of employee. They refused on the basis that the letter was not dated within 28 days of the application - i have not read anywhere that this was the case?

Can anyone advise if appeal is the best option based on the reasons of refusal?

Will really appreciate any advice

Thank you
Hi,

Well is your sister in law has given IELTS ??? if she has appeared in IELTS than its not a problem at all you just have to appeal with the IELTS certificate.

When ever you send any documents to the UKVI it shouldn't has to be older than 28 days from the day they receive those documents for your application processing.

All I can advice you is that ask your sister in law to apply for a review with a new letter from the employer just get the dates change and then wait for ages and keep praying from heart that she'll get the visa in the review.

Keep us updated on the forum.

Good luck.

@raymandsnr it was a cambridge test we have spoken to the awarding body just waiting for something in writing. Did you have to appeal or was it successful at review?

In update to this Cambridge English have said on the day of the test the college were having technical difficulties with their system and because of this the test photo was uploaded to Cambridge English systems but not the UKVI portal, do you this letter will benifit my appeal or is it just a case of the blame game that could hamper our appeal efforts

Contacted both details can be found online, can unasked which test centre you used.

Make sure you get letters of both, who was you eco as his or her initials will be on the refusal letter

Hi guys

I am new on this, basically I need some help. My husbands visa got refused and the reason was; because I get cash in hand, instead of putting the exact amount I used to round it up for example instead of putting £38 I'd put £40 and because of that they rejected my husbands visa saying that they are not satisfied with my income as the bank statements and pay slips amount don't match.

Now my query is how long does appeal take and what reasons can I give to back up my appeal??

I know I made a small mistake but that could easily be overlooked. Anyways I'm just wondering how long this whole appeal process takes. Has anyone been through it or had a similar refusal reason as me? Please get back to me. Thanks!

Look at my timeline that's a rough idea (red writing) and no idea how u can fix it as your wage slips are different and u added different amounts to your bank account, it will be just your word...or u can explain what u have done and get employer to verify your wage

My personal opinion would be, you'd be better off reapplying. It'll be costly, but a lot quicker than a appeal, which will take 4-6 months guaranteed (going by how long it's taking others) and if it goes to court, you'll be looking at a year +/-. If you don't mind the wait and want to save money, then you can try appealing. But because you purposely deposited incorrect amounts, you may not be so successful.

If you do choose to reapply and the application is successful, your husband could be here before the New Year, providing you reapply soon. With a successful appeal, he'll probably come over by next spring. He'll have to redo his TB test, then submit it along with his passport at the VAC and wait for them send it to the BHC to process which adds time.

The reason why I don't want to reapply is because Firstly it's a headache having to do everything again then spending so much money on it. Secondly if this time they rejected for such a small thing next time they might find another small mistake. That's why we are going with appeal. It's so heartbreaking, this whole process is killing me. :(

It seems like a small thing, but, really it''s a huge mistake. Having the correct corresponding documents is a requirement. Payslips and bank statements must match, no exceptions. Anyways, good luck, but don't be to optimistic.

Hi,

@Khan81 thanks a lot for updating your time line on the forum. The time looks pretty much similar to mine and stillwaiting123.

@stillwaiting123 have you heard any thing back from the FTT regarding your application review ????

@Pak86 you are claiming that your mistake is small. Well Well Well we all have submitted the exact required documents and UKVI has refused our applications on un necessary grounds and we are appealing against it. I don't know how are you going to appeal and convince the judge that its a small mistake which didn't looks like to any one of us on the forum. I can only advice you to re apply other wise waiting for an appeal is really a time taking process. Off course you are the best judge of your decisions. What ever you do just think for the consequences on your application. I've gone in to appeal cause my wifes visa got refused 2nd time and now every one advised me that there's no other option left for my self a part from appealing for my wifes visa so I did and if I am being perfectly honest with you I've made up my mind that God Forbid if I didn't win this appeal I'll just leave this country for good and will go back and live in Pakistan and will try to forget about my 15 years of my life as a bad dream or a night mare.

I just wanted to ask if any one can tell me what the paragraph below means it says on the review notice I've received from the FTT

To the Respondent
"A Notice of Appeal was lodged on 26 June 2015 against the respondent. A Copy of the notice of appeal is enclosed.

The Tribunals directs the respondent to send copies of all the documents to the Tribunal and to the other party, to include a copy of the notice of decision to which the notice of appeal relates, and any other documents provided to the appellant giving reasons for that decision, together with any statement of evidence, application form, record of interview, or any other unpublished documents on which you rely, to arrive within 28 days of the date on which you received from the Tribunal a copy of the notice of appeal and any accompanying documents "

I am confused about the above paragraph. I would like the respected group members/experts/gurus to help me in understanding the above paragraph.

Many thanks for your useful reply.

Remember me in your prayers and I'll also remember every one in my prayers.

Good luck to every one for their appeals/spouse visa application.

Hi All,

@Pak86 kindly read links of page 4 or 5 of this thread you'll find out about my whole life story for the refusal. I know that its a lot more complex than yours but still a refusal is a refusal. Yes the deadline notice is a review stage but if it fails in review it'll take another 6 months to go to the court to get the final decisions or the final verdict on your appeal case. From the appeal application to the review it took nearly 5 months or so already check my timeline or other timelines and you can figure it out by your self ,and God Forbid if you didn't get the visa in the review stage, you are looking for another 6 months after the review deadline so that will add up to almost an year time before your whole appeal thing is sorted.

@asif_sharif there's no way of checking the progress of your appeal. if you gets your review date this means that your appeal is in progress. other wise there's no other way at all in way shape of form to check the progress of your whole appeal process step by step. I know its a very sad dilemma but unfortunately that's how it is.

Again a humble request from every member please remember me in your prayers and I'll also do the same for every member.

Kindly keep us updated on the form regarding your appeals review deadlines.

Good luck to every one.
