If the application to home office in in April and you show April-March salary, then can they not match the data with HMRC ? There have been some cases where applications have been refused because the figures did not match.
We do not know what system they use and how they match the records so why take any chance mate ?

HI THERE

NEED SOME ADVICE PLS

IN MY TIER 1 EXTENSION IN 2013 I SHOWED SELF EMPLOYED INCOME TO HO APRIL12- SEP12 WITH A FIGURE OF 16K,
BUT IN HMRC FOR SUBBMITTING MY INCOME RETURN APRIL12-MARCH13 I DELCARE INCOME ONLY 7K AS SHOWED MORE EXPENSE LESS INCOME.

MY EXPENSES WERE ALMOST SAME IN WHOLE PERIOD ONLY NO MUCH INCOME IN AFTER SEPTEMBER12

MY ILR IS ALSO DUE IN 3 MONTHS TIME.

COULD ANYBODY PLS ADVICE ME??

please amend your TAX return and pay the correct tax , Please avoid doing this. as it may/may not impact future applications.

Hi Mate.

What Advice you are after damage is done ? Pay your tax
What you can do now is to call HMREV and inform them and then write a letter to HMREV request for amendment then hire an accountant and get the TR done and then you will receive bill for penalty and tax owed with interest.

what updates ? and from who? TAX amendment is not something you/ anyone controls its entirely upto HMRC's backlog, when the tax year has passed

I have been following this type of thread and want to ask a doubt:
what is the the visa year and the tax year are different :

for example:

Visa is august 2012- july 2013,, got points for 30 k from HO for self employment income
this falls in 2 tax year 2012-2013 and tax year 2013-2014.
if the tax was filled for 2012-2013 is about 21k and tax filled for 2013-2014 is about 10k.

adding up it is more than 30 k which was shown to HO.

My question:
adding up the invoice from aug2012 till april 2013 is about 20k and adding up invoice from april 2013 to july 2013 is 11k for example.
can HO ask question about the tax year 2013-2014 that the invoice total was 11k and why tax was filled for 10 k ?
can they differentiate?

They would check the right tax and NI is paid on the total income shown during extension for points so 30K in your case, But yes If they see any discrepancies or any doubt they will check with HMRC

HI Gurus,

COULD YOU GIVE ME YOUR ADVICE PLEASE...

I CAME UK IN 2006 ON STUDENT VISA AND MY WIFE CAME IN 2007 AS A STUDENT DEPENDENT VISA.
GOT COUPLE OF STUDENT VISA EXTENSION
MY WIFE APPLIED AND GOT TIER1 APPROVED IN 2011 WHERE SHE USED SOLICITOR COMPANY AND OWN PAYE JOB TO MEET THE TARGET.

I CHANGED MY STATUS FROM STUDENT TO TIER1 DEPENDENT VISA FROM HOME COUNTRY AS THERE WAS NO IN-COUNTRY OPTION AVAILABLE, I HAD A VALID STUDENT VISA ASWELL AT THE SAME TIME WHEN I APPLIED.

THE SOLICITOR WE USED WAS JAILED FOR USED DUMMY COMPANY.

APPLIED AND GOT TIER1 EXTENSION APPROVED WITH PAYE JOB AND SELF EMPLOYED BUSINESS.

NOW WE ARE WORRY FOR..

1. THE SOLICITOR COMPANY WE USED IN INITIAL APPLICATION HASNT PAID ANY TAX.

2. SUBMITTED TWO DIFFERENT SELF-EMPLOYED INCOME FIGURE DURING VISA EXTENSION TIME TO HMRC AND HO (BUT NOW A WEEK AGO WE APPLIED FOR AMENDEMENT TOHMRC FOR SELF-EMPLOYED INCOME).

MY OWN (TIER1 DEPENDENT) 10 YEAR WILL COMPLETE 2 WEEK BEFORE OUR VISA EXPIRE.

SO, CAN I APPLY FOR ILR MYSELF FIRST AT PEO (SAME DAY) AND ONCE I GET MY ILR CAN MY WIFE APPLY ON MY BASE RATHER THAT HER OWN TIER1 ILR AS WE ARE WORRIED WITH THOSE TWO MISTAKES.

LOOKING FOR SOME ADVICE PLEASE

HI EVERYONE,

MY FRIEND NEEDS A HELP REGARDING HIS ILR APPLICATION HIS DETAILS ARE:-

CAME UK 11/2005 AS STUDENT AND WAS STUDENT TILL 2010
2011- TILL DATE ON TIER1 DEPENDENT VISA AS HIS WIFE GOT TIER1 IN 2011.

QUERY:-

1. HE LIKES TO APPLY FOR HIS OWN 10 YEAR LONG RESIDENCE (WIFE NOT ELIGIBLE YET) ILR
WHICH IS DUE BEFORE HIS TIER1 EXPIRES, DOES HE NEEDS TO SHOW HIS OWN HMRC TAX
LETTERS TO SHOW INCOME AS THERE IS SOME TAX ISSUE IN HIS WIFE TIER1 LAST EXTENSION.

2. ONCE HE GETS HIS OWN ILR CAN HE APPLY FOR HIS WIFE ON HIS ILR BASED AND WILL THERE
BE ANY TAX DOCS REQUIRE FOR THAT SETTLEMENT VISA?

1. He does not need to submit employment documents for ILR based on long residence. I suggest your friend reads the Set(LR) form and guidance notes and then come back and ask questions if anything is not clear.

2. If his wife applies for a spouse visa on FLR(M), HO also do checks. If she has an issue with her tax, I would suggest she sort it out first with HMRC. Wife clock for ILR will reset to zero if she applies for spouse visa and will have to wait 5 years (2 x 2.5 year visas) before applying for ILR.

Please don't write in capital letters. It is the same as shouting and is very difficult to read.

Firstly, go easy on the capital letters. Typing in ALL CAPS is considered shouting online and is not appreciated.

What was your friend's status between 2010 and 2011? Was there any period of time when your friend did not have leave to remain?

No.

His wife will have to apply on the basis of her own Tier 1 requirements. If she changed to being his dependant, her clock would reset and she would need to spend five years from the time she switched to being his dependant. So, we are looking at at least 2020.

Getting dependent visa can she apply for her own
Ilr based on 10 year?

Yes, she can apply on her own, provided she meets ALL the requirements. Any legal visa status counts towards 10 years ILR.

but after getting dependent visa on settled person can she apply for ilr on 10 year route once she reach 10 years ??

Yes, she can.

But whenever your you/friend/wife applies for settlement under any route his/her tax affairs during stay in UK may be checked.

It seems that Illegal employment and tax irregularities are being checked thoroughly these days by caseworkers. So if there are tax issues, get them sorted and amended well in advance.
