Query:- Tier 2 sponsor (A rated) - Very small company

Post by ms10 » Fri Aug 28, 2015 6:48 pm

Dear Sir/ Madam,

One of my friends has got a job offer from a small IT company in the UK (Tier 2 A rated), and they are offering restricted CoS (to apply from India) for the job at above appropriate salary (£32k) as per SOC code (Software developer).

However, the company is relatively small but 14 years old, and as per companycheck.co.uk, as per the last companies accounts (2014), company's net worth is -ve and cash at bank is less than £1k (less than thousand pounds)

Will the company's financial situation affect the visa decision if he accepts the offer and apply the visa from India?

Kindly advise. Appreciate your answers. Thanks in advance,

If a company's financial situation had any bearing on visa decisions of prospective employees, then the first thing HO would do is suspend / revoke the sponsor license.

Hi Sush, huge thanks for your quick reply, it is very much appreciated.

Yes, I agree but whilst reading about ESTABLISHING A GENUINE VACANCY, I found this -

The employer is not established - Where an employer has provided business documents which do not show that they can sustain the employment of the overseas national, the application should be refused on not being able support the vacancy.

I am not sure if this is specific to the company's financial situation or something else. Could you please advice?

Thanks again

Isn't a company running for 14 years "established"?
Or does established means profitable?

Yes, you're right. My understanding was wrong about establishment. Its no where mentioned about company must be profitable, so my friend doesn't need to worry.

Thanks for your time and clearing off my confusion, Sush. It's indeed a great forum.
