When HO refused your application did you still have valid Residence Card? if your RC is expired can you apply for a RC card while waiting for the court hearing for your PR card? In case you reapply for PR card with extra documents and they grant it to you then you can simply cancel the appeal. Can you tell us which documents you have submitted ?

My solicitor did not send all the invoices she was thinking don need i think 4 or 5 missing. today my solicitor advised to go for appeal and same for RC, for RC my wife is working for a company and will work 31 hour/week and earn around 1100/m, in same time i already forward appeal by my solicitor. and hearing date is 28/1/16.
we can apply for PR unless we withdraw appeal or after hearing date we can apply.
About our earning £8742 in 42 month, not 60 month as 9 month maternity leave for my son and 9 months Maternity leave for my another baby 9 months.

All the amount were received as cash, cheque and through banked transfer were banked in the personal bank account with invoice ref no. Most of the payment were received as cash which banked.
the tax return show all the above figures as well for each years from 2010 - 2014.
The same minimum test as a Home office need for PR applied by local council and they said work is Gen and effective all the five years and we get HB because of this earning.
