ILR apllication

Hello everybody,

I am on Tier 1 (general) with spouse and child born in abroad. I need some advice regarding my wife and my child's ILR application.

I will be filing my ILR application before 28 days from the date I entered in UK i.e. 25/09/2015.
Will it be ok to file ILR application for my wife and child on Feb 2016 i.e. 28 days before visa expires?
If yes then can I apply for my, my child's and my wife's passport at a time?

Quick response would be greatly appreciated.

When did your wife and child apply for entry clearance as PBS dependants?
When did your wife and child enter UK as PBS dependants?
Have they both held continuous PBS dependant leave since entering UK for the first time?

Thanx for responding.

My wife and child have applied for Tier 1 visa extension on 12 march 2013.

MY wife and child both were entered in UK on 30'th September 2012 as a PBS dependants.

Yes, they both have continuous PBS dependant leave to remain since entering in uk.

my wife entered the uk at the same time as me on oct 2010 and switch to tier 1 on march 2011.
i have applied for my son's visa on oct 2012 from india where he born.

I have almost gone through east posts before posting the question here but did not get the clear answer !

I will be applying for ILR along with my dependent wife, and my partner is eligible for ILR
as per rule "'2 years if you applied for that visa before 9 July 2012'"

and I am planning to provide all cohabitation document to prove the two year period.

However i she was out side of UK for more than 90 day within last 2 year of cohabitation period ?

will this have any negative impact on ILR application, it is not quite clear whether we have to prove non absence for dependent ?



i would appericate your great inputs?

She may be okay, if she has continuous leave.

I have just rang to UKBA help line number and I have been told that the dependent should not be outside of uk more than 90 days in a given year ?

Has anycome come across this rule before pls
