hello all respected seniors..

i have completed 9 years and 1 month in the uk. i have an flro application pending.
the ground for the application is private/family life in the uk, i have also mentioned about my kids in the application..
have i submitted the right form of flr(o) or is that flr (fp) ?

and what is the difference between flr o and flr fp form ?

hope to get some answers

I think it is the wrong form. You may be asked to fill in another one.

for your info. that none of us are British or hold ILR.. STILL FLR FP ?
and if this application is refused for any reason , what is best Judicial review or another fresh app.?

What are your personal circumstances.

Any children? How old? How long have they lived in the UK?

Has your residence always being lawful .

Hi, I am in the same circumstances. But I applied in March 2015 flr(o). Biometric submitted in May . Still pending .. One child will be 7 years in October 2015. 10 years will be complete in March 2016. Let's see what's happen.

hi jupiter2016,,,, hope you ok.. you are in same situation ,,, means .. upper tribunal refused permission to appeal to upper tribunal ?
and what was your last application ? do you have any solicitor ? and finally ,,, are we going in right direction by flr o application ?
or is it flr fp ?

what i heard that , HO dont give visa on flr o ...
please let me know...

hi, it's all depend on case worker. But I think they still give right of appeal so far family is established here, In my case HO hasn't give me decision yet,One of my friend had a same situation , he covered 10 years during his UTT appeal, before his hearing he withdrew and went same day premium service. After 3 weeks he got approval .so let's pray .

in my case , upper tribunal refused the application for permission to the upper tribunal and then within 28 days, i made flr o..
is your and your friend's situation was same... please advise,

I haven't received anything yet from HO. I am worried about the appeal right to be honest,,
I have no idea about 3c because I do not understand immigration laws. was your appeal refused in upper tribunal ?

i have made flr o application , undecided and want to change to flr fp.. can I do that ?
and can I later change flr fp to another application before the decision is made on flr fp.?

Hi all ,

I need your help please on taking a decision..

i have a pending flr o application, i was told by many people that the chances of getting visas are very slim. it will be refused.
flr o is based on private/family life, article 8. none of us hold ILR or British.
my questions is , what shall I do, either go for judicial review or a fresh application after refusal of flr o.
if there are no appeal right ?

please help me out.

An out-of-time application is not covered by section 3c, so there will be no right of appeal.
Making another out-of-time application is your choice and so is applying for JR upon refusal. The merits of the case will determine if any (and which) of the two may be appropriate.

If you are given to understand that the application will fail and be refused under FP, why do you think it will be granted through JR?

With a child that is 1 month from 7 years in the UK, I believe you ought to proceed with JR or send a PAP.

I have not seen certification in cases where there are minor children.

Very Sad to hear about that dear-things are really getting scary now for all of us. I am yet to hear from them. Was it no appeal granted or out of Country appeal granted? I suppose your putting in an FLR (O) application based on 7 years child concession prior to your kids meeting 7 years continuous stay in the UK could have put you on a disadvantage.

JR comes with a number of disadvantages, apart from being a costly venture, there is no right to work and the months spent on it do not count towards 10 ILR. Furthermore, your chances of winning in this case are not high considering you put in the application before meeting the requirement.

Could the seniors advise what the repercussion of putting in an ILR application right now could be. I am thinking that could cover your 5 months, but not really sure about it succeeding, lets wait and hear what the seniors will say about this suggestion. Do not worry too much, there should always be a route to see you get to 10 years stay considering the few months u are remaining with.

Dear, I was just thinking about your situation. Since your kids have now attained the 7 years continuous stay in the UK, you might as well put in an FLR (FP) within 28 days from the time of refusal. If you are lucky, before they make a decision, you may get to 10 years and then just vary the application to ILR. Check d3thmark' s story on the link below, it is similar to what am suggesting , may be helpful.

Thanks obie. Is there only one option left for me ? If we go for JR is 3c will be there?whatever time spend on JR will it be count to 10 years? Thanks a lot in advance . Regards
