Tier 2 visa expires - application fee paid 2 days before

Post by ajk661 » Sun Sep 13, 2015 3:35 pm

Hi
I applied to renew my Tier 2 Gen visa on Friday (priority service), my visa expires on Monday. I need to travel to Ireland next weekend, so can't post my passport for the application to be processed until the following monday.

Will I face trouble at immigration returning from Ireland?? Is paying the fee and filling in the online application form on priority service enough for me to be ok? Also, posting my passport outside the 2 working days, but inside 15 days will still have my visa decided on within the 28 day grace period?

You will not be readmitted to the UK on an expired visa. Bad plan.

Submitting the online application is not the same thing as having applied for the visa (you need to submit your docs including your passport. Leaving the UK would invalidate your application. Even though you will not be stamped back into the UK (common travel area), they will see that you have travelled while your application is in the works and it will be rejected.

You might try going for a same-day appointment before you go to Ireland, but even then you will need to wait for your BRP to arrive in the post.

There is no 'grace period'. It's just that overstaying by up to 28 days will not automatically mean a refusal for future visa applications.

Your immigration status is only considered 'continued under section 3C' while you are in the UK. Ireland is not the UK. Please read physicskate's response about invalidating your application.
