Discretionary Leave to Remain Pls Help

Hi All,

Please I need advice urgently.
I submitted my FLR(O) application yesterday 10/07/15, and my visa expires on 15/07/15, however I was called into a meeting at work and was given a letter that if I do not submit a ukba acknowledgement letter by 15/07/15 when my visa expires, then my contract will be terminated.

Should I go to Croydon on Monday? will that help? Has anyone been through this before? Please help!

Have you applied for Discretionary Leave (as you subject title) or FLR(O)?
(Casa, not CR001)

Suggest to your employer that they use the UKVI employer's checking service to verify your right to continue working. Here's the link:

Thank you so much. I tried that on Friday but they are persistent on seeing a UKBA written specified named documentation on my submission.

I even presented my posted receipt, but they would not accept as proof

They are acting unlawfully.

They ought to have checked the ECS.

If you are dismissed , it will be unlawful

I have no idea what to do anymore, I'm not sure i have enough grounds, to do anything if I am dismissed.

I suggest you get your employer to read the guide (click). Talk to HR. If they still refuse, contact your Union if you have one or ACAS (click).

How can employer use ECS without a reference number?

Op must wait for the acknowledgement letter to get the reference number first.

Secondly if u see the employer guidance they mentioned that employer r exempt from any fine for 28 days after expiry of the visa. But in this 28 days time employer must use ECS to check right to work of the employee in question.

Read page 18 and 19 of this link and take a print out and show it to your employer.

Thank you all for your advice!
My employer decided to let me go, which is sad.... but they paid off my contractual 2mths notice in lieu including unused annual leave....I know it sounds funny for them to believe it is illegal to keep employed beyond 15th but still pay me off beyond the time.
But I prefer to spend this time praying and concentrating the approval of my application.

Once again thank you, I pray I will come back to testify to my further leave to remain visa approval.

I am very grateful to God for the speedy and favourable feedback from Home Office.

submitted my FLR(O) application yesterday 10/07/15
biometric was done on 30/07/15
Approved letter and passport received on 12/09/15
Awaiting biometric card.
