Tier 2 General Extension

Hi Everyone,

I need some help and information on the salary requirement for my Tier 2 General visa extension which is due on 30/11/2015. At the moment I'm working as a Design Engineer which falls under the SOC code 2126. My salary is £24000 per year and it was granted to me in November 2012.
I would like to find out the salary requirement if my employer is to extend this Tier 2 general visa under the same SOC code. Can someone please help ?

1. Does the same rules apply as when the original Tier 2 general was applied?
2. Do I fall under the experienced worker category and have to meet that salary requirement for the SOC code 2126?

Note that the min. salary for SOC code 2126 increased in April 2015. It is now £32,100 (experienced, 39 hour week).

Hi. What if during a T2 extension, the weekly contracted hours is reduced to 35hrs in the COS, and the salary pro-rated appropriately , will there be a problem ? Thanks.

I have same question if on initial applciation the hours are 37.5 and at the time of extension it reduce to 35 hours will it be problem?

shouldn't be a problem but if the HO want to check they will contact your sponsor.

Thanks manci, few questions more and will appreciate your reply.

can we also prorated the salary and include the guarenteed bonus as part of gross salary?

for example in my case the requirement is £28,400 for 39 hours if prorated on 35 hours basis then I need £ 25,487. My salary is £ 23,000 plus guarenteed bonus of £ 3,000 which will be paid twice a year( half at start and half in end of year) Is that fine?

Also from sponsor if they ask the reason to reduce the hours from 37.5 to 35 can the reason be that break time has been increased from half an hour to one hour is a sufficient reason?

My visa expiring on 28th March 2016 but the end date on my COS is 14 March 2016. Can we put start date on new COS as 29 March or it has to be 15 March 2016?

If I send my application end of March but before 28 March, will I still be eliglbe to work with my sponsor?

on reflection, you should apply on or before 14/03/2016 because although you can stay in the UK until 28/03/2016 your permission to work ends on 14/03/2016.

The new CoS, with a work start date of 15/03/2016, should be assigned not earlier than 3 months before you apply.

Ok Manci so should I apply week before 14/03/15? then I will be able to work until decision on my application.
so what I am thinking now is to ask my employer to generate COS start of March and I will send my applicaiton on 10 March which is thursday so they receieve it next day.

the CoS can be assigned any time if it is no more than 3 months before your application, e.g. in January or February. If it is left to the last minute make sure they have an available uCos allocation for 2015/16.
