Calculation Confusion - Tier 2 Change of Employment

Hi ya

Job Title :- Programmer

2136 Programmers and software development professionals
Experienced: £31,100 - Shortage Occupation list

I'm looking to Change Employment , new employer willing to offer 31,000 as per SOC 2015
Problem is the new company policy is 40 hours / per week :roll:

I think , It will affect the application :?

How to calculate salary eligibility :?:
What should be salary to be employed in SOC 2136 with 40hrs per week

Note : Year 2015 has got 53 weeks :|

Should be simple. You need to earn 40/39 * 31100 = 31897.43 to be able to satisfy the exp salary criteria in your SOC code ( assuming you are quoting it right @ 31100) with 40 hours work week. I don't think number of weeks in the year should matter.

The statement below has been extracted from the Tier 2 Modernised guidance used by UKBA officials to decide applications.

Page 55 of 136: Tier 2 Version 22.0 (Published for Home Office staff on 26 June 2015)

“Salaries should, however, be pro-rated when assessing whether an applicant is paid the appropriate rate. For example, if the appropriate rate in the Codes of Practice is £40,000 for a 39-hour week and the applicant will be paid £30,000 for a 30-hour week, the calculation is as follows:

• £30,000 / 30 = £1,000
• £1,000 x 39 = £39,000

The applicant in this example would therefore be being paid less than the appropriate rate.”


Based on the above, the pro-rated calculation for your pay would be:

Your salary: £31,100 for 40 Hours
• £31,100 / 40 = £777.50
• £777.50 x 39 = £30,322.50

From the calculation above, it means that you are PAID LESS than the appropriate rate.

For a 40 Hour week, you will need to be paid at least £31,897.44

If you check this (£31,897.44) using the calculation method above, it would give you the appropriate rate.
• £31,897.44 / 40 = £797.44
• £797.44 x 39 = £31,100
