‘’ Am I Eligible for ILR???’’
Hello I arrived Uk in October 2006 as a student, complete my Higher Diploma and MBA by April 2012, Applied for Tier 1 PSW (Post Study Work) Visa on April 2012 got my PSW visa from August 2012 to August 2014. August 2012 visa applied under EEA2 European Union Extended Family member 2 category but refused without appeal right. (It was my mistake, I haven’t submitted original Documents of my Sister – My sister is an Austrian citizen work and lived in Uk). Fresh application submitted with all original documents within 28 days. 2nd application refused again March 2015, lodged an Appel and my court appeal hearing date will be on MAY 2016. I strongly believed and have enough evidence/document to prove to get my EEA2 visa on May 2016 but for 2nd thought MY 10 years will be on OCTOBER 2016. If I didn’t win my case on court on May 2016 (By any chance) and if I go to higher court I believe It will take more than October 2016 and hear my question arise ‘’ Am I Eligible for ILR???’’

On what basis were you refused EEA2 ?

You won't be eligible for ILR based on 10 years of long residence due to refusals. Because usually the applications submitted under UK law cover by virtue of section 3C & 3D which avoid an applicant to become overstayer even after the end of their visa till the time when the appeal rights are fully exhausted. Unfortunately such protection is not available for EU route applications. However, if you succeed in getting residence permit then may apply PR after 5 years.

Yes I am married no children.
I believe HO didn't pay attention to my application, HO even changed my nationality!!!! They are not satisfied my evidence but they don't asked me to provide further documents or no chance for advance explanation
