10 year ILR (Student+Tier1) - my queries

Hi there, I am ready to apply for ILR- London in November 2015.

I was Student from 2005 to 2009,
PSW 2009 - 2011
HSMP (Tier1 general) applied - Self employed basis (no LTD company)- 2011 - 2013

2013 - I paid £7k tax + I extended and got extension till 2016. (suffered loss in self employed and paid £700 tax)

But I am eligible for 10 year Long residence this November.

My question is : During my 1st extension I have cleared £7k tax and my 2nd extension just paid £700 instead of £5k.

Does this affect my 10 year long residence?

Is it considered as deception? (as I haven't paid full amount of £5k)

If they reject, do I get right to appeal? (how does it works)

Also if they reject 10 years can I reapply on Tier 1 basis for ILR next year ? ( 5 year basis)

No matter what category you apply HO will check your tax record. pay the 5K tax you owe, it represents bad character, unless your employer has evaded tax, But it is you.

Yes, you can if you have a valid visa but they will do the same checks again and it might cause them to look more closely at your Tier 1 application and extension in the past.

Hi

You are assuming many things why Not pay the tax if in case it is refused ( i wish Not ) than you have to pay another application fees Plus Headache + 12 months earnings and many more So November is still 6 months to go so Don't waste time clear the tax and have relax mind :D .

Hi all I am eligible for ILR on 10 years basis in this November (lawful residence), my current visa is tier1 general and i have declared less tax. I am doing rework on Tax and I will be paying full tax end of this month or next month to make sure I dont owe any tax.[/size][/b]

1.Do you think they can question me about changes of tax in 1 day appointment service? (though tax is fully paid)

2. Can they reject ILR? saying you declared less tax and now you have paid full amount? I read some rejection on tier 1 basis when people have went for ILR but not heard on 10 years basis. so please advice.

3. If rejection happens, what rights do i get? and what should i do ?

What is important is that the(tax) payment should show up on your record, and that takes time (lot of time, according to what some people have posted).

Brother's CCJ appear on my File

[b][size=150][size=150][b][size=150]Hi all quickly I was checking my credit file with experian and equifax, trust online. My brothers CCJ shows with his name on my file.

Experian has removed it But I have requested Equifax and trust online to remove it as well.

Do you guys think this should be issue for me for my 10 years ILR as it says on form about mentioning CCJ and me and my brothers last name is the same and first name is very similar but not same, so they shouldn't get confused if I say 'NO' and put deception on me.

Anyways, you have 2 months to ensure that your brother's name is removed from your file. Be persistent.

Get your taxes in order before you apply and get a confirmation from HMRC. Seek professional assistance if you need to.
If the caseworker observes a discrepancy in taxes don't be surprised if the application is deferred (from what I observe is being posted on the forum).

Shall I go by myself on 1 day appointment or take solicitor with me? Incase if they question me about my rework?

Or shall I apply by Post?

What do you suggest? do I need to worry about tax re work? (if I pay full tax)

My only only question is on what basis can they reject ? so I can prepare in advance

1. 2005 passport - shows my entry in December
2. 2006 Jan - Bank Statement (HSBC)
3. 2007 Barclays May - bank statement
4. 2008 EDF energy - JUly pay slip
5. 2009 - SKY pay slip (November)
6. 2010 - HAlifax bank statement - august[b][size=150][/size][/b]
7. 2011 - HAlifax bank statement - Feb
8. 2012 Lyreco payslip (august)
9. 2013 Ecolab payslip (June)
10.2014 Rentokil - Payslip & offer letter (september)

You don't need any of these documents for ILR based on long residence. If you have been an employee the whole time and paid through a company payroll and received payslips, your tax should be up to date.

The members who are having issues regarding tax are those who were self employed.

You only need to submit the documents that the Set(LR) form asks for and yes, you can apply in person and don't need a solicitor. If you think your case is complex, apply by post or you can list your worries here and members can try to help you.

To clarify, you only need the following documents :
1. 2005 passport - shows my entry in December All passports, including the one you entered the UK with, covering the full 10 years.
12. Life in the UK test
13. University degree - (2006-2009) Is it a UK degree?
14. Photograps, application form , biometric card
15. Anything else ? I need to collect document No

2. TAx re work is HSMP (tier 1 general) which I applied in 2010 - I got it till 2013. (all tax £7k fully paid, I have the proof of HMRC)

3. 2013 extended HSMP - Teir 1 general - TAx less paid, but reworking on it and will pay full amount. (I will get the proof for myself )

So Case is straight forward[/b][/size]

Hi 'donotshare', are you doing the tax reworking yourself or by an accountant? Senior members pls help, pls suggest resources that can be be used to do the tax re-calculation. Thanks for helping.

Hi all I get qualified for 10 year Long residency in November 2015 but I was thinking due to personal reasons, Can I just extend it ? and if yes on what basis? (My current statues is Tier 1)


Because it says on HO website :

Exceptions
You may be able to extend your stay for another 2 years (known as ‘leave to remain’) even if you don’t meet all the eligibility requirements.

Can I go on this exception basis? Just wanted to know the alternative way.

Please advise.

Well you cannot do Tier 1 as that route is closed. When does your current Tier 1 G expire?

CR001 : Thanks for reply, my ILR expires in june 2016.

I read the form , but it doesn't say any criteria for extension. So I was wondering. am I qualified or do I have to extend it on Tier1 general?

What do you mean? If you have ILR, what is the question? Or do you mean your Limited Leave to Remain aka Tier 1 G?

Tier 1 General route is closed. You can no longer extend this visa. This has been the case since 5th April 2015.

When does your Tier 1 G expire?

What is your full immigration history?

If you qualify for ILR based on long residence, I don't understand why you can't apply.

To the OP

Having looked at your previous posts, I think you are mixing up your terms. I think that your Tier 1 General is valid till June 2016, but that you are also eligible to apply for ILR Long Residence in November 2015. Is that correct?

If that is the case, the answer to your question is that you can apply for ILR (Long Residence) any time between November 2015 (when you become eligible) and June 2016 (the end of your Tier 1 G visa). Be aware that the fee for ILR (and other visas) tend to go up on 6th April every year. Last year, it went up from £1093 to £1500. So, I would suggest applying before April 2016.

People on these forums are advised to apply for Subject Access Requests (SAR) with the Home Office not to submit them to the Home Office, but so that, by finding out what the Home Office has on them, they can fine-tune their applications and if necessary, provide additional information/evidence to help their applications succeed.

This will be really helpful as so I can make the arrange for future.

I know the current fees is £1400 by post £1900 by PEO. But i want to know where they inform us about rise. Thanks

Fee normally rise in April every year are announced few months before for any change.

They rise way above inflation and no one knows how much it would be in future.
