jaya.says wrote:Hi All,
Please help me I have applied naturalisation on 07/May/2015. Today i have received later stating that i have not met the naturalisation criteria. below are the details:
First Time Entered in UK : 20/May/2009
Holiday Period:
25/Apr/2010 - 19/May/2010 - 23 days not in uk
21/Dec/2012 - 8/Jan/2013 -
24/May/2014 - 02/June/2014
20/Dec/2014 -04/Jan/2015
PR: Got ILR on 01/May/2014
In the letter it has mentioned like this:
Dear J,
I refer to your application for naturalisation as a British citizen under section 6(1) of the British Nationality ACT 1981.
A person applying under this section is expected to have been in the UK on the actual date 5 years before making the application.
Your application was received in the Home Office 0n 06 May 2015. You must therefore have been in the UK on 07/May/2015 to meet the requirement.
According to your application form, you left the United Kingdom on 25/04/2010 and returned on 19/05/2010.
As your were not in the UK unit on 07/05/2015, this requirement is not met.
However, if the application is re-signed at section 6 and returned to us, we will be able to continue out consideration.
If you wish to proceed with the application, please return the re-signed application form to us by 12/10/2015.
If no reply is received by 12/10/2015, the application will be refused and the application fee less the ceremony fee retained.
They have sent me a Declaration form to sign and date what I have submitted as part of initial naturalisation application .
Note: What i got from application is I am not in UK 5 years back on the same date.
Please suggest me whether I need to proceed with Lawyer or just sign the doc send to them.
Thanks in advance
I think this is really very simple. Just re-sign the form and return it to them. It was your omission that you sent the application form to them on the wrong day, so just be grateful they did not refuse it automatically. I see absolutely no need for you to involve the lawyer.jaya.says wrote:Hi All,

By the looks of the letter. It seems that the only criteria you didnt meet was being in the uk physical on the same day five years back as the applucation date. According to my understanding if you sign the declaration which they sent you then your case is automatically approved as you were present in the uk in october five years back and also 3 years back which is a pre-requisite of naturalisation application. Taking professional advice could also help but not mandatory in ur case. Wait for some more experience responses

Hi ukmkukmk wrote:Hello everyone.
I have a quick question for those who didn't use NCS and posted their application via Special Delivery.
Did you received your approval and documents all together? and did you receive them via your pre-paid Special Delivery envelop?
Many thanks in advance for your help.
what does that mean? ' based on current nationalities'jimmy83 wrote:Looks like HO are approving cases based on current nationalities.

What are you basing that on? I thought the pattern looked more like they're basing it on date on submission of biometrics?jimmy83 wrote:Looks like HO are approving cases based on current nationalities.
It's not the day of biometric submission. I submitted biometrics on 6th of June and I am still waiting.cnicola78 wrote:What are you basing that on? I thought the pattern looked more like they're basing it on date on submission of biometrics?
I agree its hard to assume, spidyuk wrote:It is hard to make any assumptions how the HO work. We can only just wait.
It's impossible to say how they are actually working through approvals. My husband and I phoned HO in vein today, thought we may get lucky with a nice HO representative. However, we were told that it depends on the speed of the case worker and their work load. So now, we wait. Quite frankly, I would have been happy with a simple - we haven't looked at your case yet or we have... I don't need details, I just want to know something is being done.RR17 wrote:I agree its hard to assume, spidyuk wrote:It is hard to make any assumptions how the HO work. We can only just wait.
From my observation , First Spouse Approvals , then 5 years finally 10 years..
