Salary deduction for Tier 2 General?

Hi, I am IT Systems Administrator/Manager and have been on Tier 2 general for last 4yrs. Currently earning over £40K. Due to industry downturn my employer proposed my role to become an IT administrator. Yeah, it's an exercise to cut my pay. I will be applying for my ILR in a year time (Aug 2016). What is the minimum salary I need to be on when application process begins?

Also, Is there any chance I can work less hours than 37.5? Thanks

You need to be earning 35000 GBP when you apply for ILR. Your work hours should not be less than 30. I am however not sure if your role is changing , does it affect your CoS. Does it remain on the same SOC code?

Look at page 2. £35000 is fixed until 05 April 2018 so you should be fine. You will be counted as working if you work atleast 30 hours per week ( this is standard). Hope that answers your question.

Hi,

Your employer cannot pay you less than the salary mentioned on your Cos unless this is carried out on all the employees in the organization. This must also be reported to UKVI within 10 days. If the number of working hours are reduced then you may need change of employment application.

Please, google for reporting duties of sponsors and when to make change of employment application in Tier 2 visa.

Wait for seniors advice as well.

I read the duties and responsibilities of sponsor and it didn't mention about changing working hours but yeah minimum is 30hours. Are you meaning to say I need to apply for visa again if I change my contractual hours?

You may need to if reduction of hours causing your salary to go down what is mentioned on COS. The best is to check with Employer helpline.

This is what in Policy Guidance for Sponsors in the reporting section:

If you decide to cut a migrant’s salary package to a lower rate than you stated on their CoS (for example, because allowances offered have changed), the new rate that you pay to them must meet the current appropriate rate requirements.

I would suggest to wait for experts' opinions.

is there any allowances/bonuses included in your current salary?

Was there any RLMT conducted for the job you are doing or were you exempt from RLMT?
