As I'm an Indian, Indian embassy won't issue the passport until I present the existing one. Only time they can issue a new one if I said its lost and give lost reference number which I can't as its with HO.
Actually my passport is with HO for 18 Months sorry for lying. MY BAD.
I have applied for tier 1 extension and they refused the application on the basis of interview saying applicant doesn't look credible and since then appeals to FTT and UT and finally Made this Flr fp on April 25th 2015. So my passport is with HO since then.
Hope they take a positive decision soon.

I am in similar situation, came to UK in 2008 as Student, then PSW for a year 2009 and then HSMP Tier1 in 2011 at had the extension application in April 2013 they refused because of Self employed Class 2 National Insurance proof of payment
(Although Paid)was not included. After that appeals, FTT Jun 2013, UTT Feb 2014 then Judicial Review in JUL 2014 , outcome of Judicial review was on 27 Jan 2015
Negative all has the same outcome Refused. Argument was "proof of payment was not included".
Lawyer suggested FLR FP because I have a British daughter born Jan 2015 with unmarried partner and I am sole bread winner for family of 5 including 3 minors i.e. 2 children of my partner with her previous relationship. My earnings were over 30,000 for last year. I do not know if this helps.
Accidentally did application in May 5 2015 with old form, did not notice the new form has been introduced in Apr 2015.

Human rights letter 22/05/15
letter asking to submit correct fee including NHS Surcharge £500. 22/05/15
Biometric done, 29/05/15
Additional fee submitted 30/05/15
NHS IHS paid 30/5/15
Letter came July 28/7/15 Refund of the full fee and asked to resubmit the application with correct form including IHS number in the new form.
No acknowledgement received since then.
Home office contacted my employer to stop working. Employer stopped me working as I do not have right to work in the UK. Reason being my leave expired before the application was submitted. i.e.
APRIL 2013
My local MP wrote to them however to allow me temporarily work but HO did not allow and advised me to wait for the decision now I am out of work for nearly 4 weeks.
No news form Home Office, contacting them on 0300 123 2241 but they keep on saying it under consideration.
One of them Suggested me to write to case worker unit to expedite the case. I wrote to them on 28/09/15. However, no decision as yet.

Now latest telephonic conversation reveals that because I mad application after my Valid leave expired hence it can take more time then the published 8 weeks time frame. But he has no idea how long can it take.
Anybody has any idea where do I stand, is there any chance in my application?
