I didn't understand your one point when you said at the end that, 'we were not awarded any fees'.
What does this mean?
Did you not pay home office the application fee (it was waved off) or what ?

CAME TO UK IN 2011, AS A DEPENDENT PARTNER VISA.
RELATIONSHIP BROKE DOWN IN 2012.
RECONCILED IN 2014.
LIVING TOGETHER AS UNMARRIED/EX with two kids.
we have TWO CHILDREN (1.5 & 3.5) BRITISH.
EX PARTNER IS BRITISH.
how can i regularlise my stay in uk.
is this under parent of a british child (flr fp) or DL application.

Winning party is usually awarded the cost of appeal in any appeal, but the judge said we're not eligible for fee award as the policy in which our case was decided came out after HO decision.

Just a curtsey message to update all affiliated board members regarding FLR-FP Application on the basis of 7 years old child of both Non-EU Parents.
It has been decided by Home Office on:
Dated:16-09-2015
& Received on
Dated:18-09-2015
Unfortunately, HO refused this FLR-FP Application and granted a right of appeal to FTT on the basis of Human Rights claim. It's mentioned in the refusal letter that Appeal must be lodged to FTT within 14 days.
Any advice would be highly appreciated regarding any new evidences or additional supporting documents and timeline for hearing date in the FTT now-a-days.
At the end, I also would like to say a bundle of Thanks to Obie (Moderator) who provided a great encouragement and kind guidance at every step to prepare the FLR-FP Application.

hi
i applied for same on 31st march 2015
got refused from home office on 28th june
right to appeal given
First tribunal heard my aper appeal on 17th august and Refused .
Now i am going for Upper tribunal .
....
my brief history
came to UK 2001 STUDENT
Married 2005 Non EU
TWO KIDS 2006 AND 2009
overstay since 2008 december
applied this year under 7 Year Child rule but no joy so far.
I will be going for oral hearing this time with upper tribunal.
any experience with oral hearing at upper tribunal will be much appreciated.

I am in similar situation, came to UK in 2008 as Student, then PSW for a year 2009 and then HSMP Tier1 in 2011 at had the extension application in April 2013 they refused because of Self employed Class 2 National Insurance proof of payment (Although Paid)was not included. After that appeals, FTT Jun 2013, UTT Feb 2014 then Judicial Review in JUL 2014 , outcome of Judicial review was on 27 Jan 2015 Negative all has the same outcome Refused. Argument was "proof of payment was not included".

Lawyer suggested FLR FP because I have a British daughter born Jan 2015 with unmarried partner and I am sole bread winner for family of 5 including 3 minors i.e. 2 children of my partner with her previous relationship. My earnings were over 30,000 for last year. I do not know if this helps.

Accidentally did application in May 5 2015 with old form, did not notice the new form has been introduced in Apr 2015.
Home office sent

Bio metric letter 22/05/15
Human rights letter 22/05/15
letter asking to submit correct fee including NHS Surcharge £500. 22/05/15

Biometric done, 29/05/15
Additional fee submitted 30/05/15
NHS IHS paid 30/5/15

Letter came July 28/7/15 Refund of the full fee and asked to resubmit the application with correct form including IHS number in the new form.

No acknowledgement received since then.

Home office contacted my employer to stop working. Employer stopped me working as I do not have right to work in the UK. Reason being my leave expired before the application was submitted. i.e. APRIL 2013

My local MP wrote to them however to allow me temporarily work but HO did not allow and advised me to wait for the decision now I am out of work for nearly 4 weeks.

No news form Home Office, contacting them on 0300 123 2241 but they keep on saying it under consideration.

One of them Suggested me to write to case worker unit to expedite the case. I wrote to them on 28/09/15. However, no decision as yet.

Now latest telephonic conversation reveals that because I mad application after my Valid leave expired hence it can take more time then the published 8 weeks time frame. But he has no idea how long can it take.

Hi Younaf

Your case is very similar to mine and I didn't remember one transaction and they said I'm not credible on that basis and they also informed my employer that I can't work so I have been unemployed for over 5 months now.

I do not know what to say to you as everytime you contact HO they will say it's still under consideration.

I have written number of emails to MP, Case working unit and made numerous calls to HO at least give me the right to work in the mean time but they don't want to do anything.

I wish and pray that you should get a response from HO soon. Be prepared to fight for it and find something to do in the meantime.

But the honest truth is they don't really care about situations. I'm at breaking point as to withdraw the application and leave the country.

Whenever I call them they say the same thing as you made application after 28days passed so technically you were illegal in the country when you made the application so it will take time and 8 weeks is just guidelines and we can't give you timeframe of the application.

i am an over stayer and i am married with a british lady and we are living together from many years , we have no kids
i was submitted to home office my application as a partner of british person and home office is asking more documents

1 . photographs
2 . any document which can demonstrate that you have a family life with your spouse within the UK

I want to know please quickly someone tell me what documents should i send them to show that i have a family life with my british spouse within the UK?

please give me reply i have less days

Hello Majid,

I submitted our social photographs, family photos as many as you can of you and your wife.
Documents means utility bills, travel tickets, receipts of any holiday. Bank statements of you transfer money to each other.

To my knowledge but please do wait for any moderator's reply.
