Central London Solicitor Impact? 10 year ILR

Hi all i am thinking to apply for ILR in December 2015 on basis of 10 years.

1. If I apply by post with Best central London Solicitor, do you think it will be quick reply from HO ? does it really helps by having best solicitor?

2. Or shall I go to the PEO by myself? without solicitor?


What is your advice?

if you plan to attend PEO for a same day decision you do not need no lawyer or representative because its applicant they talk to or would like to talk to !!

no lawyer is listed as priority on UKVI systems if their clients come from !! all ABC..Z are same !!

I attended my PEO appointment just couple of days ago for my SET(LR) application, went in 8 in the morning I was booked for half 8 though, I was seen straight away and I saw the clock it was 10 when I was walking out with a positive decision. I saw people with the lawyers or whoever they feel comfortable with but I did not see a lawyer or person presenting another when it comes to submit a case at reception

Class 2 National Insurance not received - 10 year ILR

Hi all i am applying for ILR in December on 10 year basis. But I haven't received class 2 National Insurance for my self employment for Year 2013, 2014, 2015.


Also I haven't done any self employment work after 2012, so is that the reason?

Do I need to worry?

Do you think I shall ring HMRC and order it ?

Hi

It doesn't matter if you haven't done your self employment work since 2012. You are still liable to pay Class 2 NI if you are registered with HMRC.
If you you are already registered with HMRC then you should definitely follow up with HMRC if Class 2 NI is something you require for your ILR on 10yr basis.

6 credit card defaults - No CCJ - 10 years ILR

Hi all I am applying for ILR this December on 10 years basis. I have 6 credit card defaults ( dude to personal reasons) but no CCj. I am making monthly payments to Debt collection agency.


1. Does this affect ILR?

2. Do I need to worry?

3. Do I need to mention in the ILR form?

4. Do they check credit file?


Can you you advise please.

Hi all can you please advise, Do we have to declare Defaults on ILR form, i am going to apply on 10 years basis? (I have few defaults which i am paying in installment) ( I don't have any CCJ)

Is default crime or civil offence?

does it create problem for ILR?

Does HO checks credit file?

Do a CRB check and make sure you don't owe any money to any organisation i-e Credit File Check

Default is an offence, not a Crime, Crime is normally linked to Criminal Offence. Default is an Civil offence, it can only be judged depending on what other party think of it. You must declare every useful information. As non-declaration of Civil Offence could lead to a serious offence.

Are you sure? Because some solicitors said to me only i need to declare CCj's not defaults. So I thought let me post it on forum.

You don't have to declare defaults on application only CCJ if any however try to settle or make payment plan of these default with creditors.

@jibri Thanks a lot. But is there any link for website which says 'Default' is not an offence?

As you can see people are confusing me now. I completely respect and i appreciate your reply. Have you seen or dealt with any cases before? I am making payments but I do want to know for my own understanding and for my own satisfaction.

if you search on this forum you will see many threads where this has been discussed, I have not personally experience it but I know someone who had defaults and got ILR and even BP.

@jibri So do you think is it better to declare default? because in the form it is asking about CCj, offence and crime, Civil penalty. Not sure if Default is offence.

Court Invitation - 10 year ILR

Hi all In Jan 2015 I had received a summon, from court and had invitation for hearing which was for one of my missed payment, but I spoke to Financial Ombudsman and also to North hampton county Court and made a monthly arrangement plan to pay. And then My court invitation was cancelled. ( no ccj or anything registered, i have checked with trust online )


I was reading HMRC guidance notes, they have clearly mentioned to disclose all history about debt or anything which I feel is doubt.

1. My question is do I have to mention it that i was invited at first place and then it was cancelled or shall i just mention missed payment and provide proof of payment?


2. Because I had summon, does it means that judgement or Accusation is registered against me? or does the court have my name on their list of missed payment or on their record?

3. Or Do I have to mention in HO form that I was accused ?

I think that default should not be mention on form, that's what I got impression from other posts, I will say that contact home office helpline and ask them. Share with us as well what they say, I hope some experts may shed more light on it.

Hi all I have done rework for tax and it comes around £2.5k which I need to pay to HMRC.

I was thinking to pay £1200 upfront and rest by installment.

I am going to apply for ILR in End of November on 10 years Basis.

Will it affect my ILR? IF HO makes a inquiry with HMRC because i am paying installment.

Is it legally allowed to pay in installment?

Should be a problem?

Was anyone under same situation?

You can try, but they'll add penalties and interest.

following up posts from those whose applications either refused or held for further checks one common thing I notice is the time when they were self employed and tax paid on income shown was less than required especially when they had their visa extended by showing higher incomes while tax paid on such income was relatively disproportionate

anyone who has such a back ground should settle their affairs with HMRC asap to avoid disappointment in relation to their visa applications.

if I were OP I would pay up all I owe to HMRC before I attended PEO appointment I would not risk it for few 100s

ILR Applied on10yrs basis,1 day apptmt but App on Hold

I have done previous tax amendment for Tier1 general year 2012-2013 and paid remaining amount £2.5k in full last december 2015.

My Question was what rule applies to my application 10 years long residence? or Tier1 rule ( as i was on Tier1 general for 5 years, which makes total 10 years) or can they refuse on basis of Tax amendment basis as of Tier 1 ?

What happens if they refuse? do they give right to appeal?

Or because I have applied on 10 years basis they go by long residence rule?
