This tier 2 policy update (in April 2016 ?) will be very decisive for a lot of tier-2 general immigrants in UK.

I am myself a dependent spouse and have refused taking up a separate CoS from my employer as my ILR clock will restart.

Lets hope for the best !!

It is up to the government whether to accept any recommendation or not.

So the answer to your question is - only when the government decides to accept MAC recommendations (partially or wholly) and introduces the change(s) to immigration rules.
any news ?

The rumour is that they might restrict the work for tier 2 dependents to 20 hrs. a week. Has anybody else heard the same?

The MAC have not yet published their recommendations - we are now expecting these mid-January. We will know what the recommendations are only then. Again, I should stress that these are only recommendations. The government is free to accept or reject these recommendations as they see fit.

The MAC has published their review on Tier2 visa.
It sounds like a good news for Tier2 dependents. MAC review says its not a good idea to restrict the tier 2 dependents right to work

Not restricting Tier 2 dependant work is the only good thing about the report. Skill Levy is something which is of more concerned as the smaller companies would not like to pay this hefty amount.

Also, this is not clear that will this skill levy be apply in Extension applications for the ones who are currently on Tier 2 visa or not?

Has anyone got a clue that if these recommendations are accepted, then all this will apply from April 2016? I know no one would have a clue but just asking if someone has general idea of how long it usually takes after recommendations to make it an immigration law?

I think it will be difficult to apply this from April 2016 and probably be applicable from July 2016 but no one knows what will happen.

Regards,
Hassan

I believe it will be applicable for both New and extension applications.

Please see this link for the official wording and suggestions in full from MAC:

https://www.gov.uk/government/publicati ... -migration

The "executive summary" document is particularly helpful.

Lets see how many of these translate into actual law by the government...

MAC have simply made a report and given their recommendation.

I guess the Skills charge for the employer £1000 a year may be from next year April 2017, but the minimum salary threshold £30k will be from April 2016 for all Tier 2.

Will have to wait and see for next couple of months.

The above link only talks about the skills levy which comes in from 2017.

For the current set of changes proposed by MAC we just need to wait and watch
- which recommendations become actual law by government.
- what timescale they have in mind.

Unless the Home Office publishes their official documents on this, no one can provide any concrete information at this stage.

Hi Moderators,

My visa expires in March 2016. I have been in tier2 ict since aug 2010.
Current employer willing to extend tier 2 ict for 1 more year. after 1 year, current employer will ask to go back to home country as it been extending since 6 years.

tier 2 g: another employer is willing to sponsor me for tier 2 general visa and already applied for rmlt.
is it good option to switch to tier 2 general in feb 2016 itself by saying no to current employer.

The reason is u never know what will happen after april 2016 with the new rules how strict tier 2 general will be.

appreciate your quick response.

Hi Guys,

I am a Tier 2 dependent and my wife's is applying for a tier 2 extension end of march, do you think govt. can restrict dependent rights of work ? Should I take the risk and apply for extension via normal route (which means my application might be under process when rule changes are announced on 6th April ) or should we go via priority route and get it done before 6th ? Any help would be much appreciated !

Government has announced its response to two reviews of Tier 2 policy by the independent Migration Advisory Committee (MAC).

The latest Tier 2 policy guidance for 2016 is released today (06 April 2016)

https://www.gov.uk/government/publicati ... r-2-worker

The guidance is completely silent on the MAC review recommendations and the response issued by Home office

Seniors/ Moderators,
Please can someone share insights ?
