What is the reason of refusal of your application??
We send the refusal letter to our lawyer and she said it is ridiculous that they have not written the reason for rejection of our application

In that case, contact the Home Office in every way you can. Generally, I've found that government organisations still like paper too much, so I would always send them a letter on paper in addition to emails if it's about something important.

I am just asking for my friend. His appeal allowed by court on 30th September 2015.

*(The appeal are allowed to the extent that the decision are remitted to the Secretary of state for full consideration. ))

Court said home office have 14 days to appeal in upper tribunal .

If they don't go to upper court than
how long will the home office take to issue visa?,
What is remitted mean here in decision?

Hi Lali

I'm Colombian as well, although I applied as EFM as I am unmarried. I received the same letter, except they only cite the first reason in mine: That I did not submit evidence of relationship.

I think the standard procedure is to send that letter to unmarried couples, as no marriage certificates can be sent, but in your case, maybe, because you just sent a copy, they treat you as if you have not sent anything. It fits, as they also say you have not send evidence that your husband is exercising treaty rights (you only said copies of his payslips). We did send the original payslips of my partner, and I did not get that reason (lack of evidence of treaty rights) listed in my letter.

My advise? Yes, do send originals ASAP, to the same address you sent your application, include your case ID, and ask for a new COA, with right to work. And see what happens?

I'm afraid yours seems to be quite an untangled and complicated case. Why don't you go for marriage? If you apply as an unmarried partner you are usually expected to have been living together for 2 years at least. If you don't they have a clear reason to refuse your visa yet again.

That, combined with your history of attempting a partner visa, and your current partner sponsoring a previous partner, plus, your illegal stay... euh... it really doesn't look very favourable to be honest.

I would... consider marriage, withdraw your application, reapply as married, and find a good, trusted solicitor!

But that is just me. I don't like to gamble and rather go for a sure thing.

I've sent an email to home office today to ask for my CoA.. as I've applied about 4 months ago and haven't received it yet.. then 5minutes later I received a reply (non automatic reply) saying that they'll sent my enquiry to the relevant team.

I hope I'll receive my wife's CoA soon.

Yes, I did. I'm sorry to hear that! You do need to contact them to get a new one, ASAP, quoting your case ID No. (which will very likely be your husband/partner's case ID No.+1, if they have also applied for a card). Did you manage to find the email address? If not, simply write a cover letter and send it to the same postal address as the one you sent your application, again, quoting your Case ID.

Hi,
I was in similar situation with your and got exactly same CoA with no right to work and will no revisit my case.
Dont send them original documents, if i seen your post earlier i could as well advice you not to give bio metrics. So simply withdraw your application online via Gov.Uk, you will receive your whole application and documents you sent them within 10 days and then reapply and make sure you correct the previous mistake, then you will get right to work and you will get your previous application fee back (65 pounds).

thank u for your suggestion but the problem is we cant do marriage bcoz our previous marriage divorce application is still in the court and its pending so dont know what to do now and if i can wright home office they ll allow me to work bcoz my partner what ever earn right now its not enough for us

Thing is, as unmarried you will not get right to work until the application is decided, currently an average of 4.5 months wait...

That is what I found on internet about this email.

If there are exceptional reasons why you are not able to enrol your biometric information within 15 days of the Biometric invitation letter being issued, then you must email Appointmentexceptions@homeoffice.gsi.gov.uk setting out the reason(s) why you are unable to do so.

Not sure if this is the right one. Anyway, best of luck and let us know how it is going.

I can't even remember the last post about someone getting an actual RC... I think the press that prints them broke down. Or the guy that pulls the lever that lowers the press went on strike. We need to send one of the new COA recipients with right to work over there to replace him.
