Hi,

Can tier 1 dependent child travel outside uk with parents granted with ILR?

Yes as long as the visa is valid for when child returns and if the parents got their ILR based on Tier 1 and 5 years residence.

Main Applicant got ILR based on 5 years and dependant wife got ILR based on 2 year rule and child have tier 1 dependent visa valid up to next 2 years.

Child can travel as long as the visa is valid. I am assuming the child is UK born and that you will register child as British at some point, hence skipping the ILR for the child??

Dear CR001/Moderators,

Could you please point me to the relevant section of the immigration rules that clarify that Tier1 dependent visa for a UK born child is valid and can be used for entry clearance after parents have moved to ILR through 5 yr residence.

The reason for me asking this is because I have spoken to the Entry clearance team at the heathrow airport at the following number -
Immigration Office Terminal 4 +44 (0)20 8745 4700/01
and was told by an officer that he wouldn't allow entry in such a situation.

If the child already had a PBS Dependent visa before leaving the UK it will be valid per the links Vinny has provided.
