Post by S&T » Sun Oct 18, 2015 4:28 pm

Hi Guys,

I have completed my 10 years In UK but in between i lived outside UK for 6 months without a valid VISA. Will I be eligible to apply for ILR under the 10 years criteria ?

TIA
Thanks & Regards

It depends EXACTLY how long you were out. 6 months and a day and your residency was broken. 'Up to 6 months' does not in and of itself break your long residence.

Total absences should be less than 540 days.

I was outside the country for 535 days as I was applying for my visa. And during that application I did not have a valid visa so I applied from my home country. Is that ok , will it be still considered under the 10 years route ?
Thanks & Regards

1. When did you leave UK?
2. When did your leave expire?
3. When did you apply for entry clearance?
4. When did you return to the UK?

Exact dates please!

Thought you were applying for Tier 1 Ent extension

Your absence is too long for ILR based on long residence. Your residence continuity has been broken.

6 months in one go and/ or total absence of 540 days. Cannot exceed either of these...
