workpermit rejected review chances?

workpermit rejected review chances?

Hi,

My workpermit was rejected and we file for a review request.

The reason why it was rejected was because my salary is higher than what was advertise... the case worker also pointed out that if the ad post salary was higher it could have attracted more EU applicants...

just to illustrate

advertisment post 9000 - 10000 with benefits (example amount :))

my salary that was declared in my application 12,000.

Our reason for the review request is

my salary is only 9000 but I have a 2000 housing allowance.

what do you think will be my chances for this review request?

how long will this take any ideas?

It depends exactly what was on the form and what exactly was on the advert.

The review is unlikely to be successful on this salary anyway, it may not even be national minimum wage, although you have said that this is an example. What are the real sums? And what job would you do? What does the advert say about benefits?

If you are comfortable with it, please give more details.

Also, they can refuse on additional points at the review stage than were initially mentioned.

In a nutshell, you are unlikley to get it if you have been offered more than on the advert. Please remember that there is a separate box on the form for any allowances.

hi,

the actual post was 22,000 to 28000

and my salary is 32000 (the allowance in the review request is about 7000+)

the job ad only said "with excellent benefits"

what would be your advice? re-apply?

It's been 2 weeks now... can we cancel the review request?

Why would you want to withdraw the review request?

I think this is winnable. If the review was worded correctly.

Did the form have the total salary of £32,000 in the salary box, with no benefits listed in the allowances box? What is the £7,000 allowance for?

Any allowances should be listed separately from the salary on the WP1 form.

Your employer may hear back soon. A review is free at least. They have to withdraw the review to re-apply when a review is awaiting a decision.

Your employer may have a problem if they are changing what they are saying you would get from a salary of £32,000 with no allowances on the form, to a salary of £25,000 with £7,000 allowance in the review request. They are two different situations.

If I saw an advert that said "excellent benefits", I would think that it could be many things such as flexible working, generous leave, pension scheme, bonus scheme, on site gym, or a company car.

The review is also not supposed to have new information. A new salary is new information.

it is hard to give a definite answer. If the review is unsuccessful the employer could then reapply.

Reviews are taking longer than 2 weeks at the moment it appears.
Review requests are currently taking up to 4 weeks to decide. We have taken steps to reduce the backlog of cases on the Reviews Team and hope to have resolved this by the end of November.

I have to ask my employer about the form if the allowance has been filled up...

the 7000+ is for the housing allowance... they give housing allowance of 600 pounds per month...

This coming month I will be eligible for tier 1 work permit(intra-company)... I'm thinking that this will be easier for us to secure a WP(will it?)...

My review request was rejected... My employer failed to declare it as allowance...

I just talked to my employer and they said that they will just adjust the salary to 26000 and declare 7200 for housing allowance... which would bring
my salary to 33000+.

Is this ok? the jobad posted salary range is only 22000 to 27000 with excellent benefits... is this still acceptable? or I'll just wait for my tier 1?

Good news and happy your employer was willing to go through the hoops to get this done. Some of them get weary after a first refusal.
