I noticed in the EC application form that reason for refusal by another country is asked. I have been refused entry in the US before but the reason wasn't really clear to me. The immigration officer just said that she got uncomfortable because I changed my answer (when I did not. I merely clarified something.) My passport was stamped with "Application received" afterwards. It didn't say I got refused.

Won't it be weird if I put the reason for refusal is - "I don't know"? What can I do in this situation?

Got my Visa stamped for 2 yrs today. I re-applied for it on 21st Aug and received it on 15th Sep.

My HSMP Refused

Hi,

I' so disappointed... I've sent all the documentation correct, originals and translations but my HSMP was refused because I did not reach the points regarding Education. I was claiming 30 points but I've awarded 0.

The reason for that is:

"You stated that you have a degree equivalent to a UK Bachelor."

"The National Academic Recognition Information Centre (NARIC) has confirmed that this is a page from your transcript, not the full original degree certificate."

"In line with the published guidance, no points have been awarded."

Do you think I am able to appeal from the decision, in this case? I really don't understand why they have not considered my diploma...

Anna, do you have a degree certificate? For HSMP the guidance says you must include your original degree not a transcript. The HO are not very flexible when it comes to looking at other documents, and if you want them to look at something else such as a transcript you have to explain the exceptional reasons. They have to be very exceptional!

If you have a degree, you might want to reapply but this time include the degree. (Don't forget to adjust the dates of your earnings period + evidence if it was a while ago that you applied originally.)

EC Rejection Comments :-----

You have failed to show that you merit the award of 40 points for income under the HSMP as you state. I note that work permits UK have issued
You a HSMP letter. However, I do not know what documents you have submitted to them or what you have submitted in support of your visa application.
I also do not know what, if any checks they carried out on the documents you submitted or that work permits UK had the benefit of local Knowledge in assessing
Your documentation.

I note that you have based your stated earning award on income received from xxxx1 and xxxx2 . I also note that checks completed on behalf of this office
Confirmed that you work for company mention above. I am not satisfied that, whilst doing so, you earned the income level that you state.

Your Pay slip from xxx1 and xxx2 are of type that are easily reproduced and are not in condition that reflects their stated age. They seem to have been produced in bulk rather than issued on or around the day that you are paid, as would be reasonable to expect. As such they are of limited to evidential value.

To qualify for 40 points for income you need to earn about 45000 INR. I note that the salary payments shown on you bank statements are not reflective as income level.
There is huge difference in salary deposited in your account than it need to for Sept 07 salary it is shows only 18000 INR.

I am mindful that burden of proof rest with you as applicant........



Can you tell me its better to appeal or reapply as I am getting less salary as I am not claiming Fexible Benefit and Took salary advance which is getting deductated.

Following is the explanation given by consular in my rejection letter:

In support of your application you have submitted financial documents CITI BANK. As a result of checks made by this office, detailed in a document verification report, I am not satisfied, on a balance of probabilities that this document is genuine. The bank has confirmed that the amounts you claim to have the account is
My explaination:
The bank document given by me is genuine, and to prove it, I would like to know from UK Embassy what do I need to do? As I already send my query long time back before applying for Visa, if Bank Document won't be verify will I be getting rejected? And the reply from all VFS offices in India has told me that the Bank Statement will not be getting verified. As my understanding is that no bank will issue confidential information about me without my permission, and asking to VFS was only with respect to give advance notification to Bank about UK Embassy inquiry.

Although, I spoke to my Bank and they advised me the Stamp used by Clerk in Bank is commonly used by Bank. Also advised by them, if UK Embassy need they can issue letter to UK Embassy with full confidentiality and send directly to Consular by Post or Fax, whichever will be preferable by consular.

Second Reason:
Furthermore I note that your claimed payslips from your employer are of the same quality, although you claim they detail your pay since June 2006 – June 2007. The stamps bear an extremely similar stamp as is on your claimed bank account statement – the font and style being near identical. This fact has damaged the credibility of your application and I am therefore not satisfied that your intentions and your circumstances are as you state them to be.

I am not satisfied to exercise discretion in your favour.

I therefore refuse your application.

My explination:

Bank statement is the Soft copy which I get from Bank every month, when I requested for give period time Bank Statement, bank has send me the Soft Copy and asked me to go to Branch and certified it after taking print. Also, salary Slip is the soft copy provided by my employer every month. I took all the print in the office in one go and the same quality of the paper is getting used in all the printed in the company as the supplier is the same so the paper is. Due to which all the paper is of same kind in material and finish used for Salary Slip, Bank Statement and letter issued by Shivam Tech Pvt. Ltd., Pune.

Further explanation to Stamp, I am just the victim of innocence, as its pure co-incidence that Stamp used by Clerk in CITI BANK Branch is similar kind of font and format, but as per consular the font and style is - – the font and style being near identical which doesn't give concrete result that they are same.

Under the above circumstances, I kindly request to reconsider the decision and advised to make further decision to apply for the Appeal or request CITI BANK to issue the confidential letter in the name of consular with the explanation.

CAN I RESEND THE NEW BANK STATEMENT FROM THE BANK WHICH MIGHT BE WITH DIFFERENT STAMP AND ALSO CAN I SUBMIT DIFFERENT PAY SLIPS WHICH WILL BE SAME BUT I WILL USE DIFFRENT PAPER THIS TIME AND WILL MAKE SURE BY ANY CHANSE STAMP DONT MATCH WHICH IS NOT IN MY HAND?

BANK IS ALSO SHATTERED WITH MY QUERY TO THEM, AND THEY SAID THEY NEVER HAD ANY QUERY ABOUT ME FROM UK EMBASSY IN INDIA, AS THEY KEEP RECORD OF EVERY QUERY ON INDVISUAL ACCOUNT.

PLEASE ADVISE...................

Hi

Its better you go to bank and ask for Bank Statement for Period you claimed.

As Bank Statement which Bank gives is on Offical Stationery of Bank.

Also give same payslip and clarify your points. Also Just hightlight

when you salary got credited.

Thanks Gurav,

so can i change my Bank Statement, as Bank will give me on there stationary it wont be an issue with Consulate that why did u changed ur statement, i mean the Style patter and even stamp

I dont mind doing that just asking all possible info as dont want to get disappointment from Home Office

I wud recommend better you take legal advise from a good immigration lawyer. As this is second time, dont take any chances.
I have my ILR since march 2013, previously based on HSMP+Tier1 ext. All views are my own, am not a professional on immigration matters.

Hi ,

Well you can give both bank statement and tell them how you obtain first bank statement. Still if you feel bank Statement is generated then you can cross check transcation on both statement

From your post what comes to my mind...
You provided certain documents for claiming some points... in HSMP
Later on you claim the points in EC but don't provide the same documents which you provided while HSMP approval...
Leads to mis-match according to them...
Since, when you provide some proof for some claim...
you are supposed to provide the same proof for subsequent investigation...
which you failed to do...
leadint to rejection...
Your SOLUTION...
re-apply for EC including b'th cert this time...
...;-)

Dear Friends....

Six months time limit for my HSMP is expiring on 13th jan... and i have applied for EC .

still no reply from them....

if my case is rejected.... do i have chance to re-apply for EC and do i have to appeal.

Please kindly let me know the procedure for sending appeal for EC rejection...

Liquid Asset Query

Hi..

what is reasonable amount to show to file EC.??
i m from India and i have around 1.5 lacs in Cash and 2 lacs in Shares..

will this enough as liquid fund?
please advice me soon.. as i need to apply as early as possible..

suggest me what amount will be reasonable to show as cash in my bank.. i m not taking any sponcership..

can i transfer 1.5 lack from my cousin ? what reason should i state for this inward?? does this work??

Hi everyone,
My Ec got rejected.The reason being the genuineness of documents i submitted(offer letter,payslips,bank statements).Now am planning to either reapply or appeal(they provided a form with the rejection letter to appeal against their decission).But i dont have the Approval letter(xerox also).So what should i do know to re-apply for EC ? pls help me in this regard

Hi,
[b]The BDHC will always retain the original approval letter when the visa is denied[/b]. I dont think anyone can help u if u have not even retained a xerox copy. Anyways, try contacting ur local VFS, and request them to get u a copy of the approval.

If i request local VFS,will they provide me the approval letter.if i apply for the second time,what r the chances of getting visa ?(if i justify all their queries which they pointed in first rejection)

Hi,
Its highly difficult to guarantee the chances of visa without knowing/ understanding on what grounds u were rejected in the first place. If the BDHC believes u have submitted fraudulent documents, it would be almost impossible to change their mind set, unless u do it right this time.

Hi,
You dont require xerox copy of the approval letter,mention in the covering letter that your approval letter was retained by BDHC.you can clarify this from VFS.
