GNIB rejected to register Stamp4 EUFam

Post by griffith » Sat Oct 31, 2015 6:03 pm

This Friday, my friend went to register in GNIB and he had a letter from department of justice according to which he got 5 years visa stamp but the immigration rejected to register him and said that your wife came in ireland thrice this year, once for a week, second to get marry and third which is today and she is flying back tomorrow and they had all the flight information from this year, they found out themselves when she was flying in and out, and they said that she never lived in Ireland so how can say that she is working in Ireland?
They said that you will get a decision from the department of Justice within 15 days.
I think it means that Ryanair and other airliners are sharing their passenger details with the irish immigration otherwise how can the immigration trace someone flying in and out?

If police wants to check , then they can.

If your friends wife was not living in Ireland, then she will not be entitled to Stamp 4, unless she was doing a business.

If what they said is true, then your friend is in serious trouble

Its surprising to know something like this.

We will appreciate if you can please give us bit more information.

1.Can you please tell us that this immigration interview was with GARDA in Dublin or cork ?
2.Secondly , did the applicant said she is employed or self employed ?
3.Was she british or european ? and your friend is he Pakistani / indian/ bangaadeshi etc ?
4.if you have consulted any lawyers what was their opinion ?
5.is she employed in her country of origin ? i.e if she is spanish is she working as an employee there or is she taking any benefits there weekly / monthly
6. which airlines did she normally use ?

your reply will be highly appreciated.

GNIB Dublin and she was employed in Ireland, Latvian national and her husband is Indian, no lawyers consulted yet, she is not engaged in any activities in her own country and not taking any benefits, ryanair was the airliner which she was using which is suspected to be leaking information to other authorities which is very wrong.

Thanks for your reply

Just want to determine as if it was an isolated one off event or a standard policy fill now on . Will appreciate if you can reply few more questions.

1.What are the language skills of both partners and do they speak any common language ? i.e can they both communicate with each other fluently as husband and wife . ?
2.Did this indian gentleman moved in from UK ?
3.how was their initial interview for temporary visa ( 6 months ) with Garda .... what was asked and how long was interview.
4.How long it took from initial application to date of this incident ?
5. what is the possibility that some one or may be partner had tipped off grada?
6. Was it a genuine marriage or arranged one ? as arranged one may mean some one or even partner has tipped off for money ??
7. How long did they know each other pre marriage ?

Your cooperation is highly appreciated.

When you go to the GNIB did you present your EU spouse passport? Did they check your EU spouse passport?
