Tier 2 Help - Judicial Review

Post by pachchiger » Wed Nov 04, 2015 3:13 am

i have applied tier 2 application and got refused with deception under 322(1a). home office said COS is bad quality when they checked in the system. but i spoke to my company and they said they have not replied to home office verification about me due personal reason.
i got the documents from company, COS receipt of 199£ .
i applied admin review with the document which company provided but home office refused within 4 days of submitting without checking .
so with no choice i have to do Judicial review where i have applied without pre action protocol.
so will my deception be removed and grant a visa ?
i have been in this country from 8 years.
plz help

What was the exact refusal text, excluding any personal information. Is the company an approved sponsor?
COS receipt of 199£
What is this?

thanks for reply

they say " i am satisfied that the document is false because the ukvi investigation confirmed via email 02 oct 2015 that the certificate number in question did not appear when cross checked on their systems. as false document has been submitted in relation to your application, it is refused under paragraph 322(1A) of immigration rules.
2) regarding £199 cos is that company payed £199 for COS to get unique number.

Is the company an approved Tier 2 sponsor or an umbrella company?

Have you cross-checked on your application or refusal letter that the CoS number used was identical to the one your received from the employer? In other words, is the unique CoS number generated for £199 matching the one you used on your application.

The simple answer is the refusal reason will stand as the COS submitted was false. I appreciate you are saying it is a fraud but until that point is proven then it is no more than an allegation.

Going to JR is pointless as it is not UKVI's issue you don't have a valid COS, the refusal,is right in law.

Have you gone to the Police.
