Spouse visa for my wife.

Post by davidwilkinson81 » Tue Nov 03, 2015 2:37 pm

Hello

I've got a bit of a headache!

What do I do? I married my wife on 21st Oct 2015. She's here on a fiancé visa. What next? What form and what do I do about her name?

I'm sure it's straight forward but I've had some contradicting advice! I feel I know less now than when I started ☹️

She needs to apply for the spouse visa before her current fiance visa expires, meeting all the requirements again that she met for her fiance visa.

Apply to Remain in the UK with Family (click)

Form FLR(M) (click)

Guidance Notes for FLR(M) (click)

She will need to also pay the £500 health surcharge on top of the visa fees. She can apply for her FLR(M) spouse visa either by post or in person for a same day decision which costs £400 more.

Has she not applied for a new passport with her married name?

No, not yet. Someone recommended we didn't until after the visa application.
That's why I'm worried!

Whoever advise u is wrong. Her surname changes because of marriage with u. Surname has nothing to do with the visa application.

She doesn't have to change her name to yours if she doesn't choose to.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

The trouble is, she does so I don't know whether I can apply in her married name without first getting her passport / current visa switched. It's silly really!
