Does spouse have to be in UK all through FLR(M) processing?

Post by stitaprajna » Tue Nov 10, 2015 3:14 pm

I may have to apply for a spouse visa extension as a dependent under FLR(M).

The policy says
The applicant must be physically in the UK when the application is made ...
Does my spouse have to be in the UK all through the application process?
Or, it is sufficient that she is around when I have submitted the application?

Please advise.
Many Thanks,
Stit

If you are applying for the extension then YOU are the applicant, not your settled/British spouse.

Also, in the FLR application form https://www.gov.uk/government/uploads/s ... _04-15.pdf in the applicant's spouse's declaration section on page 69, spouse has to sign the declaration saying:
Where I have provided a copy of my passport or travel
document, I confirm that it is a complete and true copy of the entire original document, including
blank pages, and I will be physically present in the UK at the time this application is submitted. I
understand that checks to confirm my status will be made. I understand that I may be asked to
submit my original passport or travel document and or other evidence of my status at any time
Does this mean spouse has to be in the UK through my application process? Or, just on the date the application is made? My wife has to travel and this will be serious issue for us.

Please help.
Many Thanks,
Stit

She does not have to be in the UK but she will have to sign the form and provide a letter supporting your application with copies of her whole passport etc.
