Ireland non eu spouse visit visa

Hi and thanks to all who reply in advance . and if directive 2004/ec /38 and fatty patty is reading this thread I will appreciate if they can contribute something as they both always been v helpful in past to my threads.
Please read from the inis website I have copied the requirements .
Now I want to mainly know about visit visas to Ireland as non eu spouse of british national .
We are married and living together in third country Pakistan for about 19 months approx .
.marriage is registered with local authorities with foreign office.

Now what I want to know is
To apply for visit visa to Ireland according to directive 2004/ec /38 as a eu family member or non eu spouse of eu
we only need to submit
Valid passport of my and eu
National spouse passport
Marriage certificate .
But according to inis web site and irish consulate Karachi Pakistan bank statement of six months with proper running is needed lump sum lodgements will not be taken into consideration

If we apply for a visit visa and submit a bank statement of six month with a balance of 4000 thousand pounds will this be enough for 30 days visit visa to accompany eu spouse.

but point we are concern is bank statement was very low sometimes in last six months like 500 pounds sometimes and sometimes thousand but now balnce is 4000 thousand is it enough or visa can be turn down just because of bank stement and if it turned down can we appeal against it as it is against the directive 2004/38ec .
To ask for bank statement and employment .

MINIMUM DOCUMENTATION REQUIRED WITH ALL VISA APPLICATIONS

• All visa applicants must be able to show evidence that they can support themselves for the duration of their stay in Ireland without recourse to public funds or resources.

• A detailed bank statement, showing sufficient funds, and covering the immediate 6 month period prior to submitting a visa application should be submitted. Lump sum lodgements made in the run up to an application being made are not taken into consideration when assessing a person’s ability to support themselves

does this apply to us as well and if yes 4000 pounds balance is enough for 30 days visit visa to accompany eu spouse.
as bank statement is needed for last six months somtimes balance was v low in last sixmonths does that going to effect the visa application.
and can visa be refused on bank statement in our case . according to directives 2004/ec/38 all above things should not be submitted by non eu spouse of eu national any ways.


• For all categories of visa applications it will be necessary to include details of any other family members presently in Ireland, or any other EU State

Below please find a list of documents required under the various categories of visas, bearing in mind that the above requirements apply to each of these categories also.

Please ensure ALL documentation listed under the relevant category is included with your application.

FAILURE TO INCLUDE ALL LISTED DOCUMENTATION WILL RESULT IN THE REFUSAL OF YOUR APPLICATION.

Spouse/Child/Partner- Qualifying Family Members who wish to ACCOMPANY EU Citizen to Ireland - Reside

If you are the non EEA spouse, child (under 21 years), or partner of an EU Citizen or the child of the non EEA spouse and wish to ACCOMPANY the EU Citizen to Ireland the following documents are required:
• Application form
• Passport
• Marriage Certificate (where applicable) – evidence (apostilled document) that marriage has been registered in applicant’s country of origin/residence
• Documentary evidence that will attest to the existence and durability of a relationship that has existed for at least 2 years (where applicable) - e.g. Registration Certificate of partnership (if applicable) or evidence of common ownership of property, joint tenancy of property, on-going correspondence addressed to both partners at the same address, financial dependence/interdependence, joint bank accounts or any other relevant documentation
• Birth Certificate (long form) for children under 21 years, parental consent, national Identity card (signed if required).
The applicant should, if intending to reside in Ireland beyond 90 days, make an application for a Residence Card of a family member of an EU Citizen to the EU Treaty Right Section, 13-14 Burgh Quay, Dublin 2.

If non EEA family members wish to ACCOMPANY an EU Citizen on a VISIT to Ireland the following documents are required:
• Application Form
• Passport
• Marriage Certificate (where applicable) - evidence (apostilled document) that marriage has been registered in applicant's country of origin/residence


• Documentary evidence that will attest to the existence and durability of the relationship (where applicable) – e.g. Registration Certificate of partnership (if applicable) or evidence of common ownership of property, joint tenancy of property, on going correspondence addressed to both partners at the same address, financial dependence/interdependence, joint bank accounts or any other relevant documentation.
• Birth Certificate (long form) for children under 21 years, parental consent, national identity card (signed if required)
• Evidence that the applicant is accompanying the EU Citizen to Ireland or evidence that the EU Citizen is already residing in Ireland

IMPORTANT NOTE
The bearer of the visa must present to an Immigration Official at an approved port of entry. Please note that a visa only grants the bearer permission to present at an approved port of entry into the State. The decision to allow entry to the State is at the discretion of the Immigration Officer and moreover the visa itself does not imply any entitlements whatsoever as to residency in the State

Get over the fear of being turned down.

I would submit the application without a bank statement. It is not needed and is not relevant to an application as a spouse of an Irish citizen. They do not require it for applications from London, and the rules are exactly the same from any other mission. See an older copy of their internal guidelines provided to the EU in response to a complaint.

Apply with what documents you have main ones are to prove relationship with EU citizen for e.g. marriage cert household bills in both names etc. which also includes banks statement that can be a proof of address too. But to show for bank statement as say for e.g. a non British related individual would show for a visit visa (to show finances to satisfy visa officer that he is well off) is not required in your case, but if you like to add it as a proof of address so be it. One thing to bear in mind you are applying from a non EU country in the embassy although rules are written and for all to see but i won't be surprise if an overzealous visa officer try and push for more documents and wont take no for an ans.

To add to that

The first part of the articles in Directive 2004 /38 EC set out the only documents required for visas. The Directive makes it clear that while visas might be required, Member States can not put obstacles in the way and is seems that such visa applications should be a mere formality

can you please tell me what happened with your visa application, were you granted,

or can you share your experience,

my spouse is european as well, I am planning to apply an accompanying visa to visit Ireland along with my spouse,

me too curious that, do I need only Passport and marriage certificate

please tell me in details thanks
