Hello All,
I am in below situation:
1. Aug 2012 to June 2013 i worked in UK with Tier 2 ICT Work Permit. since my visa validity expired i moved back to india.
2. Within 5 months, on Nov 2013 again i entered UK with Tier 2 general work permit for the same employer. and now i am working for the same employer till date.
Till Now i have not left UK for continuous 6 months (180 days). To get ILR how many more years i need to spend in UK ?
To calculate the continuous 5 years period, will UKBA consider the time i have spent under Tier 2 ICT ?
UKBA Guide says:
The applicant must have spent a continuous period of 5 years lawfully in the UK,
of which the most recent period must have been spent with leave as a Tier 2
Migrant, in any combination of the following categories:
(ix) as a Tier 2 (General) Migrant, a Tier 2 (Minister of Religion) Migrant or a
Tier 2 (Sportsperson) Migrant, or
(x) as a Tier 2 (Intra-Company Transfer) Migrant, provided the continuous
period of 5 years spent lawfully in the UK includes a period of leave as:
(1) a Tier 2 (Intra-Company Transfer) Migrant granted under the Rules in
place before 6 April 2010, or
(2) a Qualifying Work Permit Holder, provided that the work permit was
granted because the applicant was the subject of an Intra-Company
Transfer.

So as per point (x) (2)a, Will the time spent under Tier 2 ICT also be considered ?
