Well, I am afraid once you are British citizen with the British passport, you have to apply for a different type of visa for your spouse and I think she has to leave the UK to apply for the appropriate type of visa..unless she can switch:

*You can apply to extend or switch in any of these routes if you’re eligible, except if you have permission to be in the UK:

-as a visitor
-for less than 6 months – unless you got your visa to get married or become civil partners or you got your visa to wait for the outcome of a family court or divorce*.

I hope this will help. Best of luck!
Let us know what your solicitor will advise you.

I received my Residence card this morning. :D

I requested my passport back on 26 October and got it on 14 November.
My husband terminated by this company last Tuesday (10 Nov) and HO called his company on 17 November then found out this.

The caseworker called me to double check whether is it true. I told her that I called the HO helpline but they told me I don’t have to inform HO about my husband job status. So, I asked her whether this will affect my application then she checked with her manager. The answer was positive because my husband terminated by his company is out of his control and we (my daughter and I) moved to the UK while he has a work so it won’t affect my application. HO will base on the job info we submitted during the application. I also highlighted to her that I didn’t receive my COA after enrolled my biometrics and I will move out from current place in beginning of December. In fact, my COA letter was sent out on 25 October but I didn’t receive it. Maybe it is missing again. She told me don’t worry about it and I would be able to receive my COA before beginning of December 2015. This casework is very polite and nice.

I never expected I receive my Residence card this morning. I am kind of relief now and feeling lucky this casework is very efficient.

My timeline as follows:

Application Sent: 25 August
HO Received The Application: 26 August
Payment Deduct from bank account: 28 August (Fees for my husband and I)
An email sent to my husband to acknowledge received his application: 4 September 2015 (Our applications were sent in together)
Biometric letter dated/received/biometrics enrolled: 30 September /12 October/12 October
Requested Passport Back: 26 October
Received Passport: 14 November
HO called Husband’s Company: 17 November
Received RC: 19 November

WADEY 32 Im not so sure about SA being any better. It took the Home affairs back home (SA) more then a YEAR to issue my wife with here spouse visa and they still got it wrong.after almost 2 years of struggling with Home Affairs we decide to move here because at least he i can work while they handle the visa application unlike in SA.
Just hang in there

Hi WADEY 32 This is my first applied Residence Card. I guess is because many supporting documents were submitted and have a 16 months old daughter holding EU passport. Not too sure what is the actual reason. What was the reason they rejected your 1st Residence Card application?

Hello how are you?
My name is Leandro, I'm a non-EEA. I read about your application on the forum. I'm sorry for your case is taking that long!! I also saw other 2 cases of unmarried partners that is struggling to get the visa.

I came to England in August of 2015... I used to live with my partner (german national) in Ireland for 5 years. My partner works in a international company and was reallocated to London, due to this change I had to apply as a unmarried partner via EEA-EFM form to live in the country.

We applied on the 14/8/2015, and on the 26/8 I sent the biometric info on the PO, and haven't heard since!!!

I sent together with the application my 5 years visa from Ireland (Stamp 4 EUFam) and the Irish immigraton letter with the approval of my citizenship given in 2013. plus every possible documentation, old and new ones! It is being more than 3 months just waiting, this is depressing, you feel like a shit and useless!

Could you tell me your timelime since you applied? I want to have an idea about time!

I'm thinking to get some advice with SOLVIT http://ec.europa.eu/solvit/index_en.htm

I think in your case it should be worth!

Thanks!!

Leandro

Am with you nightwolf..even though the outcome of the eea 2 depends on the complexity and the circumstances of each individual application which is justified for its longevity in making decisions i still believe they re causing a lot of nervousness to applicants.EU should look into this matter because depending on individual applicant assessment they shouldn't go beyond the six months time frame..i have read a lot people comments here where decisions are not even made in a year time..no questionnaire..no interview...no home visit..nothing and holding such applicants to such emotional trauma is not fair to mankind...i think if they can't take decisions within the six months duration..they should write to such applicants explaining why they can't make decision within the six months to calm down such applicants for God sake.
I totally agree with you deeop! Emotional and sometimes even financial trauma as if they want to torture us as much for us to leave the country :| .. Many people arent even able to find jobs. in my case they didnt even hand me back my passport.. :/
