ILR Query: T2 ICT (EC in 2009) converted to T2G in 2014

Hi,
Need help on the timing when to apply for ILR?

- I travelled to UK in Nov 2009 with T2 ICT Long Term Leave To Remain visa of which Entry Clearance was done in Sep 2009.
- Visa extended in Jan 2012 (valid till Sep 2013), immediately after which I went back to India.
- I returned to UK in March 2013 on same Visa. That old visa got extended again for the second time in Sep 2013 (Valid till Oct 2014). Considering dis-continuity in my stay for more than 180 days I did not apply for ILR in 2014.
- Meanwhile in Feb 2014 I switched to T2 G and changed my employment under a new CoS (valid until March 2017). Considering my entry clearance was before 6th April 2010, I was allowed to switch.

I want to know - for my case for ILR application, does the clock start in March 2013 or it resets in Feb 2014 when I switched to T2 G?

Also, you posted here http://www.immigrationboards.com/uk-tie ... 74306.html. Does it impact me anyway on my ILR eligibility? If so please explain how.

Hi Manci, sorry can you please elaboarate, which dates are you referring to? All the dates are right.

- Entered UK in November 2009 with T2 ICT.
- left UK in January 2012
- returned to UK with same visa in March 2013
- switched to T2 G in Feb 2014 with new employer and COS. That is valid till March 2017.

Assuming your employment by the company continued while you were outside the UK in the period Jan 12 - March 13, under current rules the 5 year qualifying period will start 180 days before your date of arrival in the UK in March 2013. This of course also assumes that you will not have absences longer than 180 days in the future until you get ILR

Thanks Manci for clarification! Really appreciate your time to address the queries.

Yes, there was no break/ discontinuity in my employment during Jan 12 - March 13 period. I changed my employer in Feb 2014 in country while I converted from T2 ICT to T2 G (under new CoS).

So does it means, I will be eligible to apply for the ILR in Oct 2017 (as per earlier rule the clock starts at March 13 i.e. Feb 18 was time when it becomes 5 years)? Of course I will have to comply the 180 days absence rule.
