Tier 2- Promotion and Salary Increase

Post by Casss » Thu Nov 19, 2015 10:28 am

Dear Manci/Team,

Firstly I am a new user. So not sure if this is the right place to be checking/posting this.

This is for a friend. He was sponsored by his company in 2014 for a salary of 23K. Then he was promoted within the same SOC to a 'senior role' based on a 'Performance Review' and offered a salary of 27K in April 2015. However he's the only sponsored migrant in the company and was except from the RLMT as he was previously on PSW. The problem is that the company didn't report his increased pay on via the SMS due to the lack of expert knowledge in this field (as this is the first time this has happen) and he is now worried.
Its now 7 months since he has been receiving his increased pay after the review.

The questions are:
1. Will this be considered as a Change of Employment and will he now need to submit a new application and obtain a new work permit?
2.Can the company simply report this via the SMS system as it was done after a performance review and is a part of career progression?
3. What will be the consequences to my friend?
4.What will be the consequences to the company?

He wants to solve this in the simplest way so that he wont have any negative consequence and wouldn't have to do a new application for his visa.

Any URGENT HELP is greatly appreciated.

THANK YOU

1. No change, as long as its the same SOC with the same employer even if you're promoted to a senior level.
2. you don't need to report any changes if you're given a pay rise, the important thing is your salary should NOT go below the minimum threshold in the SOC guideline.
3 & 4. No consequence whatsoever.

Thanks justdopposite!
I'm still not sure if he needs to report the 5k salary increase as its significant & the UKBA says u need to reports significant changes. Also he doesn't want to cause problems by reporting it so late (after 6months) What if his employer does report this via the SMS now? Will it cause a problem?..

Any advice is helpful- Thanks

On a separate note, with career progression within the same SOC one is sure to receive pay rises on promotions so shouldn't the UKBA be understanding of this?!....
