Correct use of Indian & British Passport to travel

Post by arindam02 » Thu Nov 19, 2015 8:51 pm

We have just got British Passport and travelling to India in December. Hence there is no time to surrender Indian passport and obtain OCI. Since 90 days grace period is until 10th Feb 2016, hence we can use Indian passport to enter and leave India but I’m perplexed regarding entry in UK. I’d be grateful if you can shed light on the below queries please.

1. Can we use British Passport at UK Immigration to enter UK (not disclose Indian Passport and ILR at all) or it has to be in Indian passport using ILR Biometric card (don’t produce British Passport).
2. If we use British Passport to enter UK, there will not be any entry stamp by UK Immigration on Indian passport. Will that cause any issue while surrendering Indian passport. Do they check entry stamp as well.

1. Yes, you enter on British passport.

2. Should not be a problem.

The 90 days grace period start from the date on your naturalisation certificate, not the date a passport is issued, so make sure your dates are correct.

Very important to keep this in mind. The 90 days grace period is to cover you for the time that is required for you to acquire your foreign passport.

Also see this post for processing times for surrender certificates and X-visa applications.

I got naturalization certificate on the 10th Nov, hence I am okay to use the Indian passport in December.

I sent an email to Indian VFS asking same question and got a reply that it may be difficult to get a surrender certificate if they don't find an entry stamp by UK Immigration on Indian passport. Accordingly to them, it's okay to use Indian passport as long as it's within 90 days but they will also be looking for an entry stamp in UK on Indian passport to ensure a complete journey from UK to Indian and return to India.

Now, I'm totally perplexed and don't know if I can use British Passport while entering UK or need to produce Indian passport along with ILR card in order to enter UK. Can you please advise. Has anyone had any similar experience. If yes, please share.

Many thanks in advance for all your help and suggestions.

I am in the similar situation and i was planning to use british passport to enter uk as uk allows dual citizenship and doesnt bother whether u travelled on any other passport or not.
A lot of people have travelled this way successfully and didnt have issues in surrendering or getting oci..
vfs reply is fine but please dont ask the same question to hci as this question might make them aware of such loophole and they might start checking the entry stamp.
vfs is just an agency to submit and collect visa application...it has no role in deciding the applications..
Method of application: NCS Wandsworth
