Tier 2 Extension application rejected

Hello Gurus,

My application for Tier 2 General has been rejected because of following reason.

" The application was made on 8th October 2015, However the details included on your certificate of sponsorship, your perspective employment is due to start on 11th January 2016. You application was made more than 3 months before the start of your proposed employment. We have therefore been unable to award points for sponsorship, as specified under Appendix A of the immigration rules."

Please let me know what should I do ? I have a right for appeal. Should I appeal or should i submit a new application with new COS number?
Any input's will be very helpful.

there is no point of appealing.. the decision is correct, you applied too early.
On the other hand, its strange how the employer was able to generate the cos with a start date for more than 3 months the day he was generating it.

I have no idea to be honest. UKVI says i can have an administrative review for this situation. I am not sure what to do.

Hi, please clarify, I thought, reading from other posts on here, that there is no problem extending T2G at any time with a new COS ?

I may have to extend six months earlier than the expiry of current visa due to travel plans. So If my employer issues me a new COS for another 3 years. I understand a COS is valid for 3 months only . However, what is the latest start date that is allowed on my new COS in my case? as I'll be having 6 months left on my current T2 visa.

I though so as well.
Apparently your start date in New COS should not be more that 3 months in future than your application date. That's where my organisation has made the mistake of not informing me about the rule and I applied 3 months 3 days in advance..

Hi there. I have been through the same situation as you 3 years ago. I went for premium service well before 3 months of start date on my COS. My visa was hence rejected. They kept my fees and I had to ask my employer for a new certificate of sponsorship. After that everything was fine and i got 3 years Tier 2 visa.
So ask your employer for a new COS. That is what you need to do. All the best!

Thanks a lot for moral boost.. My employer is talking with the solicitor if we can appeal. If not they will issue a new COS by Monday and I will apply by premium service. Its quite frustrating to get visa refused by applying 3 days earlier..
