Please don't give incorrect advice. For ILR based on 10 years long residency, it is calculated from the date of ENTRY to the UK and NOT the date of visa start date.nasiaziz wrote:hi

I think you are miss-interpreting the 2nd statement that you are referencing to:
"when you were given permission to stay in the UK", it says "Stay" not entry, means when you are already in U.K and get your status legalize by some mean i.e. discretion, then your 10 year clock starts from the day you get the visa while already in U.K.

I came to the UK on 28 Dec 2006 thus will qualify for ILR via Long Residence on 1 Dec 2016. I also have a dependant wife. Currently on Tier 1 Entrepreneur visa expiring on 22/09/16, I have run a business which would come to have invested close to the required £50,000 by the extension period in Sept 2016. However, it is very likely I would not have been able to have made the requisite employment by then. Thus I am entertaining the idea of making an in-time application, and waiting out the two months to LR app, no matter the outcome?
Questions are:
1. As it is likely they'd refuse the T1E ext. application, are they likely to give me a right to Admin Review or Appeal? How long if any, are they likely to take?
2. I assume on hitting the deadline, I can just send in an Long Residence ILR application. This should nullify my existing AR or Appeal, right?
3. Does #2 above nullify my wife's AR or Appeal as well? If yes, that means I should file in another application for her simultaneously with my LR app. What then should she apply for/on? FLR(m)?
4. Is there a better way to buy more time as I only need 2 months from the end of my current visa to apply for LR ILR?
5. Though not the focus now, I have read Sushdmehta, Obie, Amber and other eminent members talk about a time reset on FLR(m). Does she have to wait for 5 years before applying for ILR?
