LITUk Exemption Issue for Spouse

Post by citizen161 » Mon Nov 30, 2015 9:29 pm

Hi Guys,

My partner was granted ILR last year with exemption from Language requirement due to mental health issues and now when applied for Citizenship applications she attached an uptodate letter from GP which explains that she still have same health issues but this time HO refused her application saying that they are not convinced and looking for further details. Her GP already wrote about her condition and also said that he don't think she will be better in near future I am not sure now that what other evidance or document should we sent to HO. Obviously we can ask Gp to do another letter but how better or helpful that would be God knows.
If anyone have any experience or insight please share that how we can get over this.
Thanks

Are you able to get a referral to & a supporting letter from a registered NHS consultant to back up your case?

Good luck.

Thanks much for your advice.

Is there a deadline to reply by when asking for 'Reconsideration of the deciosion to refuse'. As that would be concerning as it would take time to arrange referral and support letter from consultant.

Regards

I am not sure of timeline involved;
if there is no intimation on any official letters you have received then suggest a call to HO helpline to clarify this matter.

Thanks for your advice. I could not find anywhere in the guidelines and on the form. Will try to find out further in the meantime appericiate if anyone have any information.

Secondly got appointment with the consultant on 22 December and received this letter of refusal on 19th of November so its going to be over 28 days least.

Any guidance will be much appreciated in this matter

Thanks

In that case suggest you write to HO & advise them of the pending appointment & the timeline involved.
If they acknowledge & respond in some way you will at least know whether its acceptable or not & can respond accordingly.

Good luck.

Thanks much. Called the home office today and the advised said if not mention on the letter do it as soon as possible. Si what I take from asap- wait for the appointment with consultant or not. Although only two weeks but still it might be too long for HO. Disregard we waited for six month that they will deal with our application. Anyhow thanks guys for unbeatable support on this forum.

Hi Guys

Got a letter from treating consultant to send along reconsideration request. Would it be wise to state that my partner has attempted to attend classes and sit in for lituk test previously but its beyond her mental capacity; as she has failed the lituk twice and did not cope with the classes for B1. We are attching consultant letter, Gp letter and some historical hospital letter. Should I(as a partner) write a supporting letter to explain her condition or better go with Drs letters.

Thanks

I think the approach you are taking, with consultant's letters is appropriate.
Specialists letters probably carry more weight at the HO.

A personal & cogent letter from you can be used to explain the bigger picture & fill in any gaps.
