ILR - Guidance Required

Post by Falcon789 » Wed Dec 02, 2015 6:20 pm

Hi,
I have been going through the FAQs and documents about ILR but there were few queries that had been coming up my mind for which I thought of taking an advise from experts on the eligibility for ILR for the following scenario-

Tier 2 (ICT) - Same Employer.
First Visa - Dec'06 to Dec'08
Renewed - Dec'08 to Dec'10
Offshore - Apr'09 to Oct'10 ....19 months
New Visa - Oct'10 to Dec'12 ( overlapping visa) In UK
Renewed - Dec'12 to Dec'14
Renewed - Dec'14 to Dec'16

Since I had been offshore on behest of my employer and as per the visa rules in place from 6 Apr 2010,
Can you please advise if I am eligible for ILR based on the above info?
If not, as I would be completing 10 yrs next year end would I be eligible by then?

Can you please advise.
Thanks in Advance!!

New Visa - Oct'10 to Dec'12
Did you apply for this from abroad as a new entry clearance?

How many days absence do you have in the 10 years as I suspect that your 19 months (absence of more than 6 months) broke your continuous residency for ILR based on long residence.

Thanks for the prompt response.
Yes, the new entry clearance was from abroad. So, does that mean all the previous entries wouldn't be counted because of a long break in residency.

Thanks!!

Not eligible for settlement under ICT route, since a new EC was applied for post April 2010 change in rules.
Not eligible for settlement under LR before 2020.
