PAYE underpayment of tax

Post by sebabd » Wed Dec 02, 2015 6:29 pm

Dear sir,
I'm applying for ilr under 10yrs route next week. I have received a letter from HMRC that I have a under payment of tax £490 for 2014/15 tax year. Im currently on tier 2 visa. However I've spoken to hmrc and they sent me a letter that the underpayment will be taken from April 2016(new tax year).
Now I'm worried would it be a problem for my SET (LR) application? Could HO refuse my application on this ground ?

Could someone plz advice me.
Kind regards.

Either pay it now or include the information with the letters in your application. It should be ok as if you are on Tier 2 General, your tax is paid through PAYE and your employer will be notified accordingly through the real time system.

Thank you very much for ur reply. My understanding is this is a very common situation with hmrc and the underpayment is due but not over due yet. And PAYE tax are paid by the employer therefore underpayment or overpayment is not really my fault.

So do I have to submit the letter with my application or shall I wait for them to ask just to avoid raising an issue that was not a problem in the first place.

Are you applying in person for your ILR? If you are carry the letters from HMRC with you.

Yes, if they ask then you have the letters with you. PAYE tax is very different to self employment tax.

Just to share the tax information

If you forgot to pay your Class 2 NI or your tax is underpaid , with new rules of HMRC they take the small small payments from your salary through you employer. However they do notify you this by letter.

Cheers

No, there should not be a problem as it is PAYE tax and if you have the letters with you, HO can easily check.

Simple solution is Call HMRC tomorrow tell them you want to pay all the tax owe now on the phone and dont want them to adjust it to next financial year. They will take the payment from you.

Nothing to worry about this.
