The details of what can be required are laid out in Article 8 - Administrative formalities for Union citizens and in Article 24In accordance with the prohibition of discrimination on
grounds of nationality, all Union citizens and their
family members residing in a Member State on the basis
of this Directive should enjoy, in that Member State,
equal treatment with nationals in areas covered by the
Treaty, subject to such specific provisions as are
expressly provided for in the Treaty and secondary law.
EU law does not have much to say about that. I expect all non- EU to be fingerprinted (at GNIB) regardless what directive 238 may or may not say.You will also note that EU citizens are excluded from the fingerprinting plans. That is because it is not legal to require them to provide the fingerprints unless you require your own nations to provide it. Their families have the same protection
Most people would probably do it if told to.
