Major Health Concern..Please Advise..

Post by sambhave » Tue Dec 08, 2015 4:27 pm

Dear Members,

My wife is on Ent Visa since June2014 & I am dependent. We have been running construction company, employed 2 workers & will have invested £200,000 by June2016 before extension (though we had submitted petrol station plan in the begining)

In Feb2014 I was diagnosed with Kidney Faliure (I am in my early 30s) Doctors operated & put catheter in my tummy & since then I am on Dialysis, after this while working on building site I got infection & doctors had to operate to remove my existing catheter & put new one.
My wife is pregenent & due in May2016.

I am worried if my extension doesnt go through in June 2016 I will have to undergo third operation to remove catheter bcos this treatment is no available back home & this might affect my chances of kidney transplant in future. I wont get care & treatment back home.

Please advise what options do I have.

Thanks everyone in advance.

You are a dependant. Your right to live in UK is "dependent" on the principal migrant. The principal migrant needs qualify for extension ... not you.

Which country are you orignally from, where dialysis / associated treatment is not available? Do you know which form of dialysis are you on? CAPD or CCPD/APD?
Can you prove that dialysis / associated treatment is not available in your country of nationality / origin / permanent residence?

Dear Sushdmehta,

Thank you for your reply & bringing out some logical points.

I am an Indian national. I am on APD. This treatment is highly sofisticated & isn't available in India.( even my dr back home advices me this)

I have been running construction business bcos we get the flexibility which we would not have got with petrol station due to my constant health uncertainty ( prone to infection, kidney transplant waiting list etc)

Do we stand any chance of extension? thanks

Regards

One must meet the specified immigration requirements for an immigration application to be successful.

As previously noted, being a dependant, your extension relies on your spouse's success.

Unfortunately, it's difficult to succeed on health grounds.
