ILR long residence - date of first entry?

Post by zephyrx » Fri Dec 11, 2015 2:52 pm

Query regarding question D2 on the 10-year long residence form:
First ever entry to the UK with student visa stamped on arrival in 2004 and continuous residence since.
As far as I understand, it can be any 10-year period of continuous residence, e.g. from a subsequent entry on the same student visa in 2005 September till date of ILR application.

1.) D2. Date of first entry at the beginning of the period of stay on which this application is based. Is this the very first date of arrival in 2004 or a subsequent entry stamp date in 2005 September?

2.) E13. How long have you lived in UK? Which date to calculate from?

1. First date of arrival, exactly as the question asks.

2. However long that is from first date of arrival.

Hi,

I am confused about it as well. The complete question states
Date of first entry at the beginning of the period of stay on which this application is based
Based on that shouldn't the First date of arrival be 2005?

Thanks,

RFD

In the above link, someone suggested the date should be the entry date at the beginning of the continuous 10-year period you are basing your application on, i.e. Sept 2005.

I wonder if anyone can shed some light on this, or has had any personal experience?

Below is little bit more detail about my situation, I will be grateful if someone could provide some guidance on the matter.

Arrived in UK on Jan 2008 on Student visa
Switched to PSW in Sept 2009
Switched to T1 in Jan 2011
Applying for ILR this month on 5 year basis, using SET(O) form.

So what should be the First date of arrival for me; based on statement Date of first entry at the beginning of the period of stay on which this application is based, I believe it should be start date of T1.

Can anyone please confirm my assumption?

Thanks,

RFD

Based on other posts for SET O, the answer to your question should be the start date of T1 visa.

For Long residence, the following posts seem to suggest the entry date for whichever 10-year continuous residence period the application is based on:

Anyone can share their experience?

The "date of entry in the UK" the very first time after an entry clearance was issued to you in a category that started your ILR clock under the category you are applying for settlement.

hi

Guys what is hard to understand here?

for 10 years long residency start date is DATE of FIRST ever ever entry to the UK.

for Set O the date when first Tier 1 was granted.

Hi everyone, sorry need some clarification on question E13 of current ILR long residence form.

My situation is very similar with zephyrx's. I first arrived in 2004, but had a gap in 2006 of about 75 days which brought my absences above 540 days, so now calculating continuous stay from February 2006 when I re-entered with a student visa. So I get your response to question D2.

How about question E13? How long would I have stayed in the UK? From 2004 when I first arrived, or from 2006 the date from which I am calculating the continuous period of residence?

Many thanks for your help!

xx
